Course objectives
At the end of the lecture course students are to be able to: theoretically explain the legal system and the structure of the Czech intellectual property law, as well as its sources, constitutional and moral foundations, and in current, historical, international and communitarian context, focusing on the Czech law, especially private, and also focusing on the legal doctrines and cases; name, describe, theoretically explain, distinguish, sort and analyze the various absolute and relative rights of the intellectual property and the legal conceptual features of the protected objects of intellectual property rights and their legal overlapping; theoretical understanding of the application of general legal concepts, f.i. good faith, good morals, etc., and their importance in the intellectual property rights; theoretically understand the registration principle and overview of certain rights to be aware of the institutional basis of the public administration of the industrial property and the plant varieties rights; understand the legal management of protected objects of the intellectual property, especially to understand the contracting licenses, statutory licenses and compulsory licenses as to their purpose, content, form and systematics; understand business models and alternative management of intellectual property and its legal nature and be able to compare them; theoretically explain, analyze and assess the legal strategy of enforcement of the intellectual property, the claims arrising from these rights and the legal measures of their implementation; theoretically explain and examine the fundamental legal arguments aimed at protecting intellectual property rights; all of them in particular regarding to the copyright and neighbouring rights, patent law and utility models law, design law, plant varieties right, trademark law, law of geographical indications and the right of the domain names;
Syllabus
  • Introduction to the intellectual property law study: the aim, history, system, sources, international organisations (WIPO, WTO, EPO, UNESCO), constitutional and moral basis, survey of the public administration of the industrial property rights and the plant varieties rights from the registration rights framework
  • The basic elements of protected objects
  • The exercising of intellectual property rights (license law)
  • The enforcement of intellectual property rights (the common principles and claims)
  • Industrial property rights incl. patent law, designs law and trade mark and other signs law etc.
  • Copyright and neighbouring rights including the collective management of these rights

Lectures including the presentations; The participation of the students is voluntary.
Assessment methods
Written test - a test using the laws; score is the positive points for completely correct answers to 17 questions type of thematic "nests"; always have 2 questions for 2 points and is always 15 questions of 1 point according to the degree of difficulty; success rate of 55%.
