Course objectives
The course is focused on the field of social policy in the EU law. The main attention will be paid to the issue of social security in relation to the free movement of persons within the EU, application of the principle of equal treatment in the systems of social security and national systems of social security. Particular attention will be paid to relevant case-law of the European Court of Justice and its impact on the national law and practice. At the end of the course the student will be able to understand the problems concerning social security in the EU, interpret the EU law terms in accordance with the case law and apply them in national law.
Syllabus
  • Regulation of the free movement of persons in the regulation 1612/68 – definition of essential terms in the case-law of the ECJ – notion of social security benefits provided on the base of the regulation 1612/68 – implementation of these benefits into the Czech social security law and assessment of their compliance with the EU law. Regulation of social security in the regulation 883/2004 - definition of essential terms in the case-law of the ECJ – notion of social security benefits provided on the base of the regulation 883/2004 – implementation of these benefits into the Czech social security law and assessment of their compliance with the EU law. The principle of equal treatment and prohibition of discrimination in the field if social security law according to the case-law of the ECJ – selection of the Czech social security law institutes this principle shall be applied on.

Teaching methods
Notion of essentials terms in particular fields in the form of lecture, power point presentations, looking for relevant decisions, individual preparation and study of the decisions, presentation and analysis of the decisions, discussion.
