Course objectives
The aim of this module is to understand the legal regulation of environmental protection, especially to provide students with the overall awareness of business related issues of environmental protection. It will concentrate on emissions of polluting substances into the environment and the conflict of interests in land use from the environmental point of view. Students should understand problems regarding: • legal requirements for environmental protection in investment activities • legal requirements for environmental protection in business operations • different forms of public administration activities and the system of public administration • procedural aspects of environmental protection • liability for damages and for inconsistency with the regulatory requirements • approach of CR, EU and US legislation to the environmental protection. After completion of the module the students should be able to: a) be familiar with the legal concepts of environmental protection and its specifics on the national and international level b) implement environmental protection requirements in management of business organisation c) apply relevant procedures to comply with the environmental law requirements d) defend their rights in procedures related to environmental issues e) be familiar with the legal concept of environmental protection at EU level.
Learning outcomes
After completion of the module the students should be able to be familiar with the legal concepts of environmental protection and its specifics on the national and international level, to implement environmental protection requirements in management of business organisation, to apply relevant procedures to comply with the environmental law requirements, defend their rights in procedures related to environmental issues.
Syllabus
  • The module addresses the following topics: • Environmental protection in the Czech, European and international legal systems. History of the Czech environmental law. The position of the environmental law in the Czech legal system and related problems. Sources of environmental law and its basic principles. • Public administration and other persons and their role in environmental law. System of public authorities, forms of their activities. Their competence and powers. The role of the public in the environmental protection. • Conflict of interests in a particular area. Environmental requirements set by the law that must be met by investors in the procedures under the Construction Act. Aspects of soil, water, air and nature protection, cultural heritage protection. Practical implication. • Environmental impact assessment. The procedure for assessing the impact of given buildings, activities, technologies, programs and plans to the environment. Practical implication. • Integrated prevention and pollution control. Defining of the facilities under the IPPC permit system, procedure, legal requirements, inspections. Practical implication. • Legal regulation of the air protection, water protection, nature protection, agricultural and forest land protection and use. Direct and economic regulatory tools. The basic legal duties of individual persons. Permitting processes. Case studies. • Legal regulation of waste disposal and requirements for packing of products. Basic legal duties of individual persons involved in production and disposal of the waste. Administrative and economic tools and sanctions. Import and export of waste. Case studies. • Chemical substances. Prevention of serious accidents. Legal tools for dealing with dangerous substances. Emergency planning. • Health protection. • Liability in the environmental law; criminal liability, liability for damage and ecological damage, liability for the breach of the law, enforcement. Case studies of claims and disputes. Procedural issues. • The right to own a property and environmental protection requirements. • The environmental protection in Constitutional law. The right to a favourable environment and ways how to enforce it. Case studies.

Assessment methods
Number, Type and Weighting of Elements: 100 % written assignment Type and Weighting of Methods within Each Element: This module is assessed by means of a written assignment (2,000 to 3,000 words) and a written exam. Illustrative assignment and assessment criteria: Identify negative impacts of you firm to the environment. Make an analysis of legal means to protect the environment. Apply regulatory requirements to your company in the field of environmental protection. Identify cases of breach of the law and the ways how to find appropriate remedy and compliance with the law. Compare different approaches to defend your rights. An answer to this question would be assessed against the following criteria: a) completeness of the analysis b) critical evaluation and discussion of the main factors and their influence on the environment and identification of adequate regulatory measures c) ability of practical implication d) logical conclusions with practical, achievable recommendations. Learning outcomes assessed: a) to d) above Expected Form of Feedback: Formative and summative feedback will be provided to each student individually. Written comments with individual coursework assignments. Verbal feedback where required.
