Course objectives
The basic two objectives of this course are to obtain an overview of a) the legal functioning of international business transactions with special regard to the purchase - sale transaction and b) alternative ways of resolving disputes arising from these transactions with a special focus on arbitration. After completing this course, the student will be able to understand the legal regulation of international business transactions, formulate and create simple contracts or contractual conditions (based on the assignment). Student will be able to solve model cases in the area of international trade and uznderstand the basic principles of arbitration.
Learning outcomes
Student will be able:
- to provide legal solutions to simple legal problems arising from international;
- formulate basic contractual clauses;
- propose a dispute settlement mechanism.
Syllabus
  • 1. law applicable and applicable rules to international trade transaction;
  • 2. clauses governing the dispute settlement mechanism;
  • 3. non-state law and its links to state-law;
  • 4. solution of the model-cases according to CISG;
  • 5. solution of the model-cases according to INCOTERMS ;
  • 6. overall concept of the model case from the perspective of international arbitration.
