Philosophy for Laweyrs provides an introduction into the basic categories and problems of the critical legal thinking.

Course objectives
At the and of the course student should be able to: understand and explain the basic terms and categories of legal philosophy- natural law, positive law, justice
work with information on the development of the legal thinking to better understandig of the theoretical basis of law;
interpret contemporary problems of the legal philosophy
Syllabus
  • -What is legal philosophy?
  • -What is law? law and moral;
  • -Natural law versus positive law;
  • "Sein" and "Sollen", normativity and reality of law;
  • -Criticism of legal formalism;
  • - The system theory of law versus discoursive theory of law;
  • - Theory of legal interpretation;
  • - What is justice? Law and justice;
  • - The philosophical foundation of human rights.
