Course objectives

Introduce the students to the field of study to other issues of national substantive and procedural criminal law, as well as to the issue of the relationship of both mentioned branches of criminal law to financial law, from the point of view of their interfaces. After completing the course, the student will be able to have a basic orientation in the development of the criminal aspects of the current criminal "financial" law, i.e. in relation to the criminal liability of both natural and legal persons, and also in relation to criminal acts related to financial law, but will also be able to have an orientation in procedural areas that are connected with financial law, e.g. in relation to insurance institutes or proceeds from property criminal sanctions.

Learning outcomes

After completing the course, students will be able to: • characterize the basic features of the crime, the basics of criminal liability of natural and legal persons • know the differences and legal qualification of property and economic crimes • orient yourself during Czech criminal proceedings • perceive the increasing influence of the European legal environment on Czech substantive criminal law and on the Czech criminal process • to realize the perspectives of further possible development of Czech criminal law in relation to financial law

• Syllabus • Criminal act (misdemeanor) and its factual nature. • Forms of the crime (preparation, attempt, completion, criminal cooperation, organized crime, concurrence and recidivism, exclusion of the criminality of the crime and extinction of the criminality of the crime). • Penalties, protective measures, measures, extinction of penalties, protective measures and measures. • Special part of substantive criminal law (systematics and content, relationship between general and special parts of substantive criminal law). • Selected crimes and their legal qualifications (especially property and economic). • Fundamentals of the criminal process. Subjects of criminal proceedings. Evidence and decisions in criminal proceedings. • Special part of procedural criminal law (stages of criminal proceedings). • Security institutes in criminal law in relation to financial law. European context (influence of the EU on the development and direction of criminal law).

Teaching methods

Explanation of the basic theoretical institutes of substantive and procedural criminal law based on the interpretation of principles accompanied by concrete practical cases. Analysis of selected cases and their legal qualifications. Analysis of selected decisions of the courts of the Czech Republic and the European Union. An interactive way of lecturing that responds to any suggestions from the students. All the main issues are presented using a powerpoint presentation, which is accessible in the faculty's information system. Other possible materials also available in the interactive outline.

Assessment methods

Teaching is based on lectures, which assume the active involvement of students. Emphasis is also placed on individual preparation (study of laws, cases, literature and PowerPoint presentations). The course ends with a written exam consisting of theoretical questions and analysis/solution of a case focused on financial law, i.e. application of theoretical knowledge to a specific case. The analysis of the example will evaluate not only the correctness of the chosen solution, but also the ability to justify it.
