Course objectives
The aim of the course Civil law III is to perfect the present knowledge of the course Civil law for the purposes of the higher justice oficers position (see namely par. 10 of the Act). At the end of the course the student wil have the practical knowledge of the course Civil law.
Syllabus
  • The subject-matter of the lectures: 1) Natural persons: Personality. Capacity of the natural person to the juridical acts. Capacity of minors and individuals incapable/with limited capacity to the juridical acts. Statutory representative (quardian), the tasks of establishments of social services. Representation of the natural persons on the base of power of attorney. 2) Legal persons (entities). Personality. Capacity to the juridical acts. Juridical acting of legal entities. Representation of legal entities. 3) Legal entities of civil law. Summary. Companies of public weal. Foundations and Funds of foundations. Register of legal entities of civil law. 4) Selected questions of juridical facts. Juridical acts and its structure. Electronical form of juridical acts. Contracting. Pactum de contrahendo. Culpa in contrahendo. Contract in civil law. Civil law times (periods, times), relationship to the justice oficers practice. 5) Property law. Summary. The function of courts in the procedure of formation, change, termination and protection of property law. 6) Rights to another persons things. Summary. The function of courts in the procedure of formation, change, termination and protection of rights to another persons things. Cadastre (of immovables); relationship to the justice oficers practice. 7) Obligations law. Formation of obligations. Responsibility (liability) for defects. Chosen questions of securement of obligations. 8) Change and termination of obligations of the view point of the justice practice. Legal custody (deposit in court). 9) The customers protection, relationship to the justice practice. 10) The types of contracts. Contractus innominatus, contractus mixtus in the justice practice. 11) Delictual and quasidelictual obligations in the justice practice. 12) Inheritance in the justice practice.
