Course objectives
The purpose of teaching the subject of Family Law is to deepen the understanding of European historical contexts and tendencies and, in particular, the human rights dimension of family law, including its foundations and systemic integration into the legal order, at the level corresponding to the doctoral study program. Attention is also paid to sociological and psychological aspects of family and family law. Teaching is internally structured. Attention is paid first to marriage and marriage law, including marital property law and family housing in connection with individual legal institutes and also protection against domestic violence. Separate attention is focused on the legal aspects of divorce, including its consequences and links to the rights of minor children of spouses. No less attention is focused on so-called alternative forms of cohabitation and their institutionalization, models in Europe, on analysis of marriage, on partners law, on the issue of parenthood, balancing of legal, social, and biological parenthood in relation to the child's right to know his or her origin and in the light of the case-law of the European Court of Human Rights. The study concludes with the issue of alternative family care and so-called public intervention in family and family life.
Learning outcomes
After completing the subject, the student will be able to identify the development of family law in the European context, especially in connection with the human rights dimension of family law in the light of the case-law of the European Court of Human Rights. The student will also be able to critically formulate considerations on designed law, especially in light of the Principles of European Family Law.
