Course objectives
The aim of the course is to analyze the basic parameters of non-contractual obligations with an international element. The question of whether the parameters of the offense are identical in Czech law as well as in large legal systems such as German or French law and whether they correspond to the parameters of this institute in Anglo-Saxon systems will be addressed. At the same time, the case-law of the Court of Justice defining the parameters of delicts for the purposes of EU private international law will be analyzed. It will also analyze the conflict of laws rules on non-contractual obligations with an international element, which is contained both in the EU legislation and in international treaties and national regulation. Given the wide variability of non-contractual obligations with an international element, the identification of the applicable standard constitutes the basis for the entire legal application process.
Learning outcomes
Students will be able to identify and summarize basic atributes of non-contractual obligations with an international element in a comparative perspective. Furthermore, they will be able to define what type of source (international treaty, EU legislation, national law) will be used to determine applicable law for individual types of non-contractual obligations. They will be able to interpret and apply the relevant legal rules. They will be able to justify their choice on the case law of the national courts or the rulings of the Court of Justice of the EU.
