Course objectives
The aim of this course is to understand the doctrines of international commercial arbitration and their impact on the nature of international commercial arbitration and its particular institutes. Specific attention will be devoted to the role of the law of the state in which arbitration is seated.
Learning outcomes
At the end of the course students will be able:
to characterise the doctrines (jurisdictional, contractual, mixed, autonomous); to explain the nature of international commercial arbitration from the point of view of these doctrines; to explain the nature of key institutes (arbitration agreement, arbitrator, arbitral award) from the point of view of these doctrines; to explain the role of the law of the state in which arbitration is seated from the point of view of these doctrines.

Seminar work (minimum 10 pages, maximum 15 pages) on one of the following topics: 1) Analysis of the selected doctrine (characteristics, history). 2) The impact of doctrines on the nature of arbitration agreement. 3) The impact of doctrines on the person of arbitrator and his relation to the parties. 4) The importance of seat in international commercial arbitration. 5) Doctrine of international commercial arbitration in the Czech Republic including the relevant case law of Czech courts.
