Course objectives
Judicial Review introduces students in the development of the institution of Judicial review in the world and on the territory of the Czech Republic since 1867. Particularly is analysed the valid legal regulation of the position, organisation and types of procedures before the Constitutional Court of the Czech Republic in the view of theory and practice. The students should be able to analyze particular form of the Constitutional Court's rullings and to prepare drafts of petitions for such proceedings.
Syllabus
  • Constitutional law, constitutionality, legality and the means of their protection. Constitutional review and administrative review. Constitutional courts in the world. The Constitutional Court of the Czech Republic. Sources of the legal regulation. Legal status. Organisation of the Constitutional Court - the Plenum, the Panels, the Chairperson and the Vice-Chairpersons, the Rapporteurs, Assistants to Judges. Competence. General provisions concerning the Proceedings before the Court. Proceedings on the proposed annulment of a statute or some other enactment. Preventive review of international treaties. Constitutional complaint and the renewal of proceedings. Proceedings in remedial actions against a decision concerning certification of the election of a Member of Parliament. Proceedings in cases of doubt concerning a Member of Parliament loss of eligibility for office or the incompatibility of some other position or activity with holding that office. Proceedings in cases of the President of the Republic. Proceedings concerning measures necessary to implement a decision of an International court. Proceedings in jurisdictional disputes between a state body and a body of a self-governing territorial unit. Disciplinary measures.

Lectures are not obligatory. Oral exam emphasiying the knowledge of the practice of the Czech Constitutional Court.
