Course objectives
At the end of the course students should be acquainted with the constitutional evolution in the Czech territory since the rising of a modern state, with the concept of modern state and its particular exposures in our constitutional history, with the basic instruments of constitutional character from the pre-constitutional era, with the constitutions of monarchy and with the constitutional evolution of ČSR, ČSSR and ČSFR until 1992. The students will get a basic survey of a historical evolution in general as well as of constitutional concepts and their evolution since the 17th century.
Syllabus
  • 1. Basic terms of the theory of constitution and constitutional law (constitutionality, constitution as a fundamental law, sovereignty of the people, particular features of democracy
  • 2. From the Pragmatical sanction 1713 over the reforms of Josef II. to the General Civil Code 1811.
  • 3. The year 1848 and the constitutions of the Austrian Empire.
  • 4. The December Constitution 1867 as a road to the law-abiding state.
  • 5. Basic features and structure of the Czechoslovak Constitutional Charter 1920.
  • 6. The breakdown of the Czechoslovak constitutionality in 1938 - 1939. The Czech-Slovak Republic (s.c. Second Republic). Protectorate of Bohemia and Moravia. Independent Slovak state. Temporary government in exile (s.c. London establishment). Basic features of legal enactments in the period of 1938 -1945.
  • 7. Restoration of constitutional order and legal continuity in 1945 – 1946. State bodies and constitutional legislation in 1945 - 1948.
  • 8. Basic features of the constitutional development in the period of 1948 - 1960.
  • 9. Basic features of the constitutional development in the period of 1948 – 1960. The socialist constitution 1960. Constitutional Act 1969 on the Czechoslovak federation.
  • 10. Basic features of the constitutional development in the period of 1989 - 1992.
