- Course objectives
- Posluchači tohoto kurzu se seznámí s institutem mezinárodní smlouvy nejprve z hlediska mezinárodního práva. Poté budou aplikovány tyto poznatky na právo mezinárodních smluv uzavíraných Evropskou unií a nakonec si posluchači ujasní promítnutí do českého ústavního práva. Cílem kurzu je dosáhnout porozumění složitého systému tří uvedených oblastí. Absolventi by měli zvládnout výklad mezinárodních smluv, pochopit jejich aplikaci v právu EU a rovněž řádně aplikovat smlouvy ve sféře českého právního řádu. Akcentuje se komplexní pohled na mezinárodní smlouvu ze všech hledisek.
- Syllabus
- 1. International treaty as a source of International Law. Vienna Convention on the Law of treaties. Categories of treatie, their conclusion, entry into force, interpretation, aplication, reserves. 2. International treaty in EU law. Categories of treaties in the EU law. EU as subject of International law. Specific features of treaties concluded by the EU, their position in EU law. 3. Treaty in the Czech domestic law. Domestic sources (Constitution and others). Interpretation and application by Czech authorities. Binding force of treaties in Czech internal law. Specific features of treaties concluded by the EU. 4. International treaty as a tool for creating international legal norms. Comparision with other possibilities (EU secondary law, soft law).
