Course objectives
This subject folows interconnect of theory teaching on criminal law and criminal process law with its practical application during the session of a court of the first instance. The aim of this subject is bestowment of theoretic and practical opinion on place and role of criminal law and criminal process law by the enforcement of criminal justice during the hearing on the court of first instance. At the end of the course students should be able to interpret and apply criminal law on the concrete criminal cases.
Syllabus
  • - Introductory incoming in the problematic of realisation of criminal law in the law framework of criminal process law :
  • o General explications about interpretation and aplication of criminal law and criminal process law in stages of prosecution
  • o Current constant judicature to the session of a court of first instance [hearing]
  • o Relationship of criminal law and criminal process law from point its practical use in the hearing of view
  • o Decision and its forms in the hearing
  • - Role of court in the session of a court of first instance
  • o Aim of prosecution and its fulfillment in the session of a court of first instance
  • o Preparation of the session of a court of first instance and tasks of president of senat
  • o Role of the court in the phase of carrying out of evidences in the hearing
  • o Closing part and decision in the hearing
  • - Role of the public prosecution in the hearing:
  • o Public prosecution as a subject of accusation in the hearing
  • o Preparation of public prosecution to the hearing
  • o Role of public prosecution in the phase of carrying out of evidences in the hearing
  • o Closing speech of public prosecution in the hearing
  • - Role of defence in the hearing:
  • o Accused as a object of accusation in the hearing
  • o Preparation of barrister to the hearing
  • o Role of barrister in the phase of carrying out of evidences in the hearing
  • o Closing speech of barrister in the hearing
  • o Last speech of accused
  • - Attendance of students on the demonstrative hearing at court of first instance and discussion with president of senat, public prosecution, barrister
  • o Argument of decision in the hearing
  • - Stage-manage hearing at the Faculty of Law: (judge plus internal teachers)
  • o „Teaching“ hearing under leadership of president of senat district court and internal teachers, in attendance of students, in the criminal case under sp. zn. 15 T 10/2007 (teaching file)
  • o Discussion about theme written works for colloquium, in deadlines of teachers
  • o Theme of written works announce internal teachers including its formal parameters on the start of autumn semester, each in count seven.

Colloquimu on the base of written work.
