Course objectives
The graduate will be able to elaborate in the relationship to the concrete commercial-law case a processional submission, typically a claim or rendering to the claim, to elaborate a decision of the court or another agency based on the knowledge of commercial law or civil processional law and reasoned appeal or other remedy. The student which will graduate this course will be full exploitable in praxis without the neccesity of the training and the familiarization with the legal and court file.
Syllabus
  • 1. Introduction to practical issues of commercial law enforcement. Receivable (term, maturity, accessories, invoice, 1200 CZK). Pre-War Reminder. Action, application for payment order. Judgment, payment order. Appeal, Resistance. Costs of the proceedings and their quantification. Other selected procedural issues. 2. Law of Obligations. Recovery of Obligations Due to Withdrawal from the Purchase Contract I. Staged Court Negotiations. 3. Law of Obligations. Recovery of obligations as a result of withdrawal from the Purchase Contract II. Staged court proceedings. 4. Law of Obligations. Enforcement of obligations from the purchase contract concluded at the e-shop. Staged court proceedings. 5. Law of Obligations. Enforcement of contractual penalty. Competitive clause. Recovery of damages / unjust enrichment. 6. Interim measures, unfair competition. 7. Arbitration. Staged court proceedings. 8. Arbitration - international arbitration, sports arbitration, practical experience. 9. Unfair competition. 10. Unfair competition. Marking interchangeability. 11. Interchangeability of trademarks. Intangible harm. More topical issues. Awarding of colloquiums.

Teaching methods
The practical preparation of students to the seminars, working out the processional submissions, the debate about the sticking points and the practise of the action of the students in front of the court in the role of the attorney and the judge.
Assessment methods
The processing of the case-studies, individual and team work, analysis, claims, decisions of the courts, expressions and so on.
