Course objectives
Culmination of any legal training in US is the taking of the bar. The goal of this course is to acquaint Czech students with the California state licensing examination or “The Bar”, as it pertains to the law of contracts and torts. Student should acquire an appreciation for what is tested, how, and what test skills are required to pass.

  • A. Contracts
  • Presentation of salient concepts and cases inviting comparison to Czech law by the students
  • I. Formation of contracts: offer, acceptance, consideration, defenses performance, 3rd party issues, breach of contracts, remedies
  • II. MBE Multistate multiple choice contracts bar exam questions
  • III. Law school and Bar contracts essay questions
  • B. Torts
  • Presentation of salient concepts and cases inviting comparison to Czech law by the students
  • I. Intentional torts, negligence, per se, res ipsa loquitor, strict liability, land issues, proximate cause, nuisance, defamation, miscellaneous torts, product liability, defenses, remedies
  • II. MBE Multistate multiple choice torts bar exam questions
  • III. Law school and Bar torts essay questions
Literature
  • Study materials will be handed out during the course
Teaching methods
These classes will examine what American law students learn in law schools about contracts and torts and what is necessary to know in order to pass the bar. Students shall take and analyze actual bar exams questions. As there are performance, essay and multiple choice aspects to the exam, substantive law will be reviewed on a as needed basis. Students will presented with past exam questions and asked to analyze them. Substantive law review and discussion will ensue.
Assessment methods
As this seminar is meant to be interactive, students will be graded for their participation and overall performance during seminars. Attendance is compulsory.
