Cíle předmětu
At the end of the course, students should have the ability to:
(1) Understand and explain the international framework for the law of climate change, along with selected aspects of regional and national developments;
(2) Develop and work with information concerning primary themes and problem-areas involving climate change;
(3) Create and integrate an interdisciplinary perspective to the subject; and
(4) Formulate deductions on the acquired knowledge, interpret new materials and enhance analytical skills in research, writing and oral presentations with the goal of stimulating further study in the field.

Výukové metody
Course time is devoted to lectures and discussion with an emphasis on active student participation. All of the assigned material is required reading and necessary in order to succeed. Failure to keep up with the reading and discussion will impair the ability to learn.
Metody hodnocení
Students will research and write a paper on a topic related to the assignments in the course. The paper will conform to the Faculty’s requirements discussed the first day of class.

This course explores the framework for the law of climate change with an emphasis on its current status and challenges. The analysis addresses international, regional and national developments with a holistic perspective that integrates law, economics and science.
The primary focus is on an introduction to the field. This includes consideration of the Climate Change Convention, the Kyoto Protocol and significant developments since the adoption of these agreements. Topics for discussion include common but differentiated responsibility, climate change and trade, technical assistance, monitoring, reporting, verification, public participation, intergenerational equity, traditional knowledge and climate change and human rights.
Major themes are analyzed in recent developments in the EU, the U.S., China, India and other influential participants in international environmental governance. Leading cases at the international level, including the conflict over the EU airlines emissions tax, are considered in illuminating areas of controversy. Contemporary negotiations with direct links to other aspects of climate change, like the newly proposed EU – U.S. trade agreement, are also discussed with a view to anticipating “the shape of things to come.”
The course considers climate change in an evolving context in light of “law on the books” and “living law” as the international community grapples with new approaches to the problems presented.
Students download international agreements available online without cost including the Climate Change Convention, the Kyoto Protocol and related instruments published by the UN EP. Specific themes are addressed in additional materials available online without cost including Trade and Climate Change (2009), published by UN EP and the WTO. Other materials are used as necessary with selected issues and several lectures will draw on Economic Foundation of International Law, Eric Posner, Alan Sykes, Harvard University Press (2013) but this does not require any purchase.
