Prerequisites
The course is intended for the student interesting in the issue of human rights in general and especially with regard to the issue of interpretation of those fundamental rights, where a number of prejudices persist. These include the interpretation of the fundamental right to life, rights of the child and rights of the sexual minority (LGBT).

Course objectives
At the end of course students should be able to:
critically reflect on the usual ways of interpreting the right to life, the rights of children or sexual minorities,
identify prejudices in the interpretation of fundamental rights;
create their own argumentation strategies for the interpretation of specific cases in the field of fundamental rights protection;
Syllabus
  • -Explanation of basic concepts and problems of human rights theory. The question of human rights justification: what concept of human rights justification do we need? What is the interpretation and interpretation of human rights in particular?
  • -Methodological issues of human rights interpretation. Interpretation of human rights at national and European level.
  • - Interpretation of the legal concept of life. Why did life become right? Three levels of interpretation of the right to life: i) Who has the right (power) to decide on life? ii) Who has the right to life? iii) What a life we ​​are entitled to
  • -Interpretation of the right to life in the light of biomedical technologies.
  • -The baby is not a thing. Conceptualization of the concepts of child and childhood in legal-philosophical thinking. Power/knowledge as a tool for granting or rejecting children's rights in legal discourse. Organization of protection of children's rights in the Czech Republic. Critical analysis of the right to children's participation in guardianship proceedings in the Czech Republic.
  • - Equal treatment, discrimination and legal protection against discrimination. Rights of sexual minorities - trans people and their rights
