Cíle předmětu
The aim of this course is to introduce the students to a general overview of origins and conceptual framework of the law of torts in the UK. In the end the students should have a comprehensive knowledge about the concept of causation in Tort, different categories and relevant international aspects.
Osnova
  • Session One: Origins and conceptual framework. Trespass Torts. Session Two: The evolution of the Tort of negligence/breach of duty from actions on the case via Donoghue v Stevenson to Caparo v Dickman. Session Three: The concept of causation in Tort - difficulties and solutions Session Four: Special situations in negligence: - Economic Loss, Psychiatric Harm, Occupier's Liability and Employer's liability. Session Five: Nuisance Torts. Remedies - damages and injunctions. Session Six: International aspects - jurisdiction, forum conveniens and the Brussels and Rome II regulations.
