Course objectives
The course is aimed at the basic overview of current environmental law and at gaining experience in its legal interpretation and practical application. It will be focused on basic legal instruments and forms of their application, based on practical examples and case-studies. The course will provide students with understanding of following topics. - legal requirements related to development activities - legal requirements related to operational activities from their environmental impact point of view - organization of public administration and forms of it outcomes - liability relations in environnmental law - specifics of environmental law procedures - relation to international and EU law. The overal aim of this course is to provide stuidents with abilities to interpret and to apply environmental rules in the firéld of their non-studies.
Syllabus
  • 1. Environmental protection in the Czech, EU law and international law systems. Environmental law in the Czech legal system and relation to other legal fields. Sources of environmental law. Environmental protection in constitutional law. Right to the favourable environment and right to environmental information and their enforcement tools. 2. Institutional system and environmental law persons. System of public administration authorities, forms of their activities, powers and competences. Administrative procedures in environmental law. Participation of the public. 3. Liability in environmental law. System of liability relations. Administrative liability. Criminal liability. Civil law liability, Ecological Damage Liability. Instruments of their application. 4. Conflict of interests in the land-use. Environmental protection in procedures held under Construction Code and mining laws. Legal aspects of nature protection, cultural heritage protection and protection of individual environmental components. 5. Environmental Impact Assessment (EIA). Assessment of impacts of constructions and other activities and their changes on environment. Strategic environmental assessment (SEA). Integrated prevention and pollution control (IPPC). Delimitation of IPPC facilities. IPPC procedure and permit requirements. 6. Protection of the air. Basic regulatory requirements. Administrative, economic and penal instruments and their application in practice. 7. Water protection. Basic regulatory requirements. Administrative, economic and penal instruments and their application in practice. 8. Agricultural land protection and protection of forests.Basic regulatory requirements. Administrative, economic and penal instruments and their application in practice. 9. Nature protection I.Basic regulatory requirements. Different regulatory instruments and their application in practice. 10. Nature protection II.Basic regulatory requirements. Different regulatory instruments and their application in practice. 11. Legal regulation of waste. Basic regulatory requirements. Administrative, economic and penal instruments and their application in practice. Legal regulation of transboundary movement of the waste. 12. Chemical substances management. Prevention of industrial accidents. Legal instruments for environmental protection in the field of chemical substances management and use. Emergency planning.
