Course objectives
The aim of the subject, following the subject Administrative law in the bachelor degree, is to give the students a deeper theoretical basis of the topic of function of public administration, especially in terms of legal approach and systematical view; the subject deals also with the legal and non-legal forms of implementation of public administration, the main kinds and elements of such forms. Also some specific powers of administrative bodies (legislatory, discretionary, controlling and sanctionary) are considered. The subject deals with the requirements set upon the activities of public administration as a part of public autority, with the relation of the administration and individuals, with the topic of good administration, with the creation and functioning of european administrative space, with the control of the public administration and with the liability of public administration, too.
Syllabus
  • 1. The function of public administration. The concept and system. The forms of implementation of the public administration. 2. The legal and non-legal forms of implementation of public administration. The kinds and elements of the main legal forms. 3. The problems of legal interpretation, indeterminate legal concepts, discretionary powers. 4. The legislatory powers of public administration (including internal regulation), implementing powers. The role of the judicature. 5. The supervisory powers of public administration, state control. 6. The sanctionary powers of public administration. Administrative punishment. 7. The requirements put upon the function of public administration. Efficiency. The principle of legality. The protection of fundamental rights and freedoms, including the european dimension. 8. The principles of good administration – national and european context. 9. The participation of citizens in public administration. The transparency of administration. 10. The reliability, predictability and liability of public administration. 11. The protection of specified information in public administration. The protection of personal information. 12. The control of public administration. The system of control.
