The course is offered to students of any study field.
Course objectives
The aim of the course is to provide, following the study of Fundamentals of Administrative Process in the Bachelor's programme, a deeper theoretical basis of the issues of administrative processes in general and special regulation, including the area of administrative punishment, a more thorough understanding of the regulation and specifics of individual types of administrative processes, the position of the persons concerned in these processes, as well as the resolution of defects in procedures and decisions within the public administration, and also in the framework of judicial review, especially in the administrative justice system.
Learning outcomes
After successful completion of the course Administrative Procedural Law: - understands the place and importance of administrative procedural law in the system of administrative law, - is able to apply the basic principles of the activities of administrative authorities, in the individual forms of procedural procedures of administrative authorities, - has an orientation in individual procedural procedures of administrative authorities, - is able to apply the provisions on individual procedural procedures and main procedural acts, - is able to orient in relevant case law and is able to use it for the elaboration of specific concepts and submissions.
Syllabus
  • The concept and position of administrative procedural law in the system of administrative law. Concept, types and features of administrative processes (procedures). Claims to due administrative process, status of persons concerned. Systematics of the Administrative Procedure Code. General and special regulation of procedural procedures, principle of subsidiarity. Principles, procedural concepts and course of administrative proceedings. Defects in administrative proceedings and decisions, review of decisions under the Administrative Procedure Code, protection against inaction. Measures of a general nature, procedure for their issue and review. Public law contracts and their regime. Regulation of other acts of administrative authorities, and handling of defects. Procedural specifics of administrative punishment and its review. Procedures implemented in the administrative justice system, types of actions and their application; cassation complaint.

Teaching methods
Collective consultations (lectures) in face-to-face and online form, supported by e-learning through an interactive curriculum, developing distance learning using study materials and practice answer sheets. Self-study of designated parts of the required literature.
Assessment methods
Written exam - a test containing the solution of a specific partial assignment (example) and answering several test questions.
