Course objectives
This course deals with environmental law as a specific branch of law, and the content of the course is primarily aimed at enabling the non-law student to understand the mission of the subject of environmental law in its entirety, to be able to explain its functions and to argue its merits. The student will be able to work with the sources of general and special parts of environmental law, will be able to explain the functions of the various institutes of special environmental law and will be able to form legal opinions on model cases, identify the authority competent to decide on these cases and draft the necessary submissions. At the end of the course, the student will be able to solve practical examples from the discussed area in such a way that he/she can apply the acquired knowledge in his/her future application practice.
Learning outcomes
At the end of this course, the student will be able to work with sources of general and specific parts of environmental law, will be able to understand the nature and mission of the subject of environmental law in different areas, explain its functions, argue its rationale and relationship to other branches of law, and will be able to apply the tools of environmental protection in a broad context. Specifically, the student will be able to: understand and explain the general principles of environmental law; understand the system of environmental law regulation; explain the main concepts of environmental law; solve selected problems in the field of environmental law by applying legal norms and case law, especially in the special part of environmental law (in the legal regulation of individual environmental components).
Syllabus
  • 1. Organizational Information. Introduction to environmental law. Subjects of environmental law. Organisation and forms of public administration activities in the field of environment.
  • 2. International legal obligations of the Czech Republic and constitutional enshrinement of the right to a favourable environment.
  • 3. Fundamentals of administrative procedural law and administrative justice.
  • 4. Environmental protection and processes under the Construction Act - systematics.
  • 5. Legal regime of air protection and climate protection.
  • 6. Legal regime of water protection and water resources.
  • 7. Legal regime for soil and forest protection.
  • 8. The legal regime for the protection of nature and landscape and the protection of animals against cruelty.
  • 9. Legal regime for waste and packaging management. Ionizing radiation.
  • 10. Integrated permitting (IPPC). Emergencies.
  • 11. Conflicts of interest in the protection of cultural heritage.
  • 12. Land expropriation and environmental protection. Land development.
  • 13. Workshop - attendance at a municipal (regional) council meeting or attendance at a court hearing.
Literature
Teaching methods
The course is based on interactive forms of teaching, work with legal regulations and case studies, etc. Students are expected to prepare before each seminar. Part of the course is a workshop - to attend a meeting of a municipal (regional) council or to attend a court hearing, and to take minutes of this meeting.
Assessment methods
The course is concluded with an oral examination, during which students answer the examiner's questions from the course. The aim of the examination is mainly to verify the student's ability to solve practical examples from the given area.

Teacher's information
Please note that the course will be taught using interactive teaching methods and in a rather practical manner with an emphasis on "trying out" the tools of environmental law. An example (case study) will be assigned for almost every seminar, the homework of which is a prerequisite for participation in the seminar. Attendance at the seminars and workshop is compulsory and a total of two unexcused absences will be tolerated.
