Course objectives
Main objective of the course is to acquaint students the administrative procedural law, not only from the theoretical point of view, but also by providing them with basic practical skills. Subject respects changes derived by the transformation of public administration and administrative law in the Czech Republic, especially in connection with the adoption of new Administrative Procedure Code.
At the end of the course students should be able to: • have comprehensive knowledge of administrative procedural law • understand branch specific administrative procedures – building permits, management of cadastre, etc. • work with sources of Czech administrative procedural law.
Learning outcomes
At the end of the course students should be able to work with the sources of administrative procedural law in order to interpret and apply them in concrete cases.
Syllabus
  • 1. Concept and nature of administrative procedure - public administration - state administration and local authorities, administrative authorities - basic concepts and institutes, principles.
  • 2. Bodies of administrative proceedings - parties to proceedings - legal personality.
  • 3. Legal acts of the parties - elements of legal acts - drafting an application, practical examples.
  • 4. Administrative proceedings - opening of proceedings - evidence - decision.
  • 5. Specific provisions on administrative proceedings. A mid-term test - a joint action, contentious proceedings, on the spot proceedings, etc. - public authorities concerned - obtaining evidence, explanation, binding opinion.
  • 6. Application for a building permit procedure - subsidiarity of Code of Administrative Procedure - comparison with general administrative proceedings, diversity - practical examples.
  • 7. Cadastral proceedings- subsidiarity of Code of Administrative Procedure - comparison with general administrative proceedings, diversity - practical examples.
  • 8. Hearing of an administrative delict - subsidiarity of Code of Administrative Procedure - comparison with general administrative proceedings, diversity - practical examples.
  • 9. Decision-making and decision in public administration - types of decisions - legal power and enforceability of decision.
  • 10. Regular remedial measures - elements - proceedings - drafting an appeal, remonstrance.
  • 11. Extraordinary remedial measures - elements - new trial, review proceedings - failure to act by administrative authority and defence against it.
  • 12. Judicial scrutiny of public administration - administrative justice - constitutional justice - drafting an application to court.
  • 13. Lodging complaints and other options of defence by participants in administrative proceedings - protection of participants in administrative proceedings - public guardian of rights - right to information.
  • Lectures are scheduled in three blocks according to the following topics:

Teaching methods
Tutorials, readings, person-to-person tuition, homeworks, partial written proofs, data mining.
Assessment methods
The course is concluded with written exam.
Students are eligible to take the exam provided that they fulfil the given conditions: 1. they actively participate in at least 60% of workshops, 2. they hand in a seminar paper in a given extent and structure within the obligatory date; 3. they pass the test (a test is regarded as successful if at least 60% of answers are correct).

For students with ISP or on an internship, conditions 2. and 3. mentioned above apply (i.e. except for 1. - active participation in tutorials)
Any copying, recording or leaking tests, use of unauthorized tools, aids and communication devices, or other disruptions of objectivity of exams (credit tests) will be considered non-compliance with the course completion conditions and a severe violation of the study rules. Consequently, the teacher will finish the exam (credit test) by awarding a grade "F" in the Information System, and the Dean will initiate disciplinary proceedings that may result in study termination. The mentioned procedure relates to all the activities included in the course's final evaluation (seminar work, essays, tests, etc.).
