The course requires basic law knowledge acquired during the study of secondary school and basic legal skills obtained in the field of financial consulting.

Course objectives
The course aims to introduce the functioning of legal order as a system that affects the whole economy in the state.
Students will be acquainted with:
- Basics of the theory of law, sources of law and their systematics.
- Material, territorial, personal and temporal scope of legal norms.
- Problems connected with realisation and application of legal norms.

The course will be mainly focused on the role of private law in the legal order of the Czech Republic. The essential importance of legal principles for interpretation and application of private law regulations will be explained on practical case studies.
The following issues will also be explained:
1. The practical importance of legal facts (including limitation and preclusion).
2. The distinction among different types of legal responsibilities (including the burden of proof).
3. Classification of persons in a legal sense. Formation, incorporation and termination of legal persons. Representation of legal persons.
4. Specifics of entrepreneurship as one of the possible economic activities including basic business forms.
5. Creation, modification and termination of obligations and their securing.
6. Consumer protection regulation in accordance with the Czech Civil Code (“NOZ”).
Learning outcomes
At the end of the course, a student should be able to:
- describe and understand the current system of law in the Czech Republic;
- explain the basic concepts, principles and institutes of private and public law and to apply them in the field of financial consulting;
- search for relevant legal information in the legal information system (ASPI) and public portals and to use it practically;
- be versed in general legal regulation of obligations and the most frequently used contractual types in the field of financial services;
- apply the legal regulation of consumer contracts and consumer legal protection in the field of financial services.

  • 1. Introduction to law.
  • • Basic concepts and institutes. Law and other normative systems.
  • • System and structure of law. Positive and natural law. Public and private law.
  • • Sources of law. Concept, substance, classification.
  • • Legal norms. Concept, substance, classification. Structure of legal norms. Validity and efficiency.
  • • Lawmaking. Application. Interpretation.
  • 2. Private law.
  • • Basic concepts, institutes, principles. Enforcement of private subjective rights.
  • • Legal facts, juridical acts. Concept, substance, classification. Good faith. Due managerial care. Limitation and preclusion. Legal responsibility.
  • • Rights in rem. Registers of things. Land register. Administration of property. Forms of administration of property.
  • • Persons in a legal sense. Natural persons. Legal persons. Juridical acts made by persons.
  • • Entrepreneurship. Concept, substance, legal context. Entrepreneurship of natural and legal persons. Czech Commercial Register. Czech Trade Register.
  • 3. Obligations.
  • • Basic concepts, institutes, classification. Creation, modification and termination of obligations.
  • • Consumer vs a person with average intelligence vs professional.
  • • Consumer contracts. Specifics of consumer contract concluding. Principles of consumer legal protection when concluding a contract.
  • • Concluding distance contracts. Contracts negotiated away from business premises. Right of withdrawal from the contract. Duty to provide information.
  • • Consumer credit contract.
  • • Consumer Protection Act. Financial Arbitrator Act. Competent institutions of public law consumer protection (the focus of protection, subjects of protection, the authority of executive bodies within consumer protection, rules for submitting motions and complaints).
Teaching methods
Lectures, discussion, presentations and case studies solving.
Assessment methods
The course is concluded with a written exam. The final written test usually consists of 25 questions awarded in total up to 100 points. To pass the written exam students need to get at least 60 points.
