Student bude po absolvování předmětu schopen: - identifikovat základní problémy vázané na soukromoprávní poměry s mezinárodním prvkem - určit a popsat základní doktríny mezinárodního práva soukromého - popsat základní principy, které ovládají české a unijní mezinárodní právo soukromé - řešit jednoduché příklady z oblasti mezinárodního práva soukromého - sepsat klauzurní práce na témata probíraná v rámci kursu

Course objectives

The course in Private International Law II is focused on the international procedure law, european international procedure law and international arbitration law. At the end of this course the student should be able to understand the system of rules applicable in this area, should be able to explain the jurisdiction of the national courts in cases with foreign element, should be able to analyze the conditions for the recognition and enforcement of the judgment issued by foreign courts. He should be able to explain the differences between the international arbitration procedure, ADR and litigation. He will be able to formulate the arbitration agreement, to explain the arbitration procedure and the enforcement of the arbitral award.This part of the course is devoted to the seminars and to the discussion on the above mentioned topics.

Other regulations creating the common justice area in the civil matters. IV. International commercial arbitration, mediation, conciliation. V. International arbitration agreement. VI. Selected questions relating to the arbitration procedure. VII. The recognition and the enforcement of the arbitral award.

Course objectives

The course Private International Law II is focused on the international procedure law, european international procedure law and international arbitration law. At the end of this course the student should be able to understand the system of rules applicable in this area, should be able to explain the jurisdiction of the national courts in cases with foreign element, should be able to analyze the conditions for the recognition and enforcement of the judgment issued by foreign courts. He should be able to explain the differences between the international arbitration procedure, ADR and litigation. He will be able to formulate the arbitration agreement and to explain as the arbitration procedure as the enforcement of the arbitral award.This part of the course is devoted to the seminars and to the discussion on the above mentioned topics.

Course objectives

The course will be devoted to the creating of common justice area in Europe. The subject is the analysis of Brussel Connvention I and its moving into direction, Roma Convention from 1980, Lugano Convention.

Syllabus

Creating common European judicial framework - the analysis of the Treaty of Rome on the law governing the contracts - the analysis of the Brussels Convention on the powers of courts and the recognition and enforcement of the courts' judgements - interpretation activities of the European Court of Justice in respect of the above-mentioned treaty and convention - the analysis of the Lugano Convention on the powers of courts and recognition and enforcement of courts' judgements. The seminars for the first part will anylyse the issues of arbitrary contracts, arbitrary findings and their enforcement , termination, etc.

The basic prerequisite for attending this course is the participation in the course in International Private Law I. Passing through the course in Civil Law and Business Law can be seen as a favourable prerequisite for the students from other faculties.

Course objectives

Syllabus

Creating common European judicial framework - the analysis of the Treaty of Rome on the law governing the contracts - the analysis of the Brussels Convention on the powers of courts and the recognition and enforcement of the courts' judgements - interpretation activities of the European Court of Justice in respect of the above-mentioned treaty and convention - the analysis of the Lugano Convention on the powers of courts and recognition and enforcement of courts' judgements. The seminars for the first part will anylyse the issues of arbitrary contracts, arbitrary findings and their enforcement , termination, etc.
