Course objectives

The course Private International Law II is focused on the international procedure law and especially european international procedure law. At the end of this course the student should be able to understand the system of rules applicable in this area, should be able to explain the jurisdiction of the national courts in cases with foreign element, should be able to analyze the conditions for the recognition and enforcement of the judgment issued by foreign courts. He should be able to explain different aspects of the cases in the area of the private and procedure international law. The exam consists as from PIL I, as from PIL II.

Learning outcomes

The student will be able after completing the course: - identify and describe the issue of private relations with the foreign element; - identify and describe the jurisdiction of the courts in the whole segment; - determine the applicable law in the whole segment of the issue; - describe the processes of recognition and enforcement of foreign decisions.

Course objectives

The course Private International Law II is focused on the international procedure law, european international procedure law and international arbitration law. At the end of this course the student should be able to understand the system of rules applicable in this area, should be able to explain the jurisdiction of the national courts in cases with foreign element, should be able to analyze the conditions for the recognition and enforcement of the judgment issued by foreign courts. He should be able to explain different aspects of the simple cases in the area of the private and procedure international law.

• EU private international law. Sources of the european international private law. Civil jurisdiction and judgments (history, outline, scope, domicile, jurisdiction, recognition and enforcemnt of judments). Other conventions and regulations creating the european judicial area. International arbitration law.

The course Private International Law II is focused on the international procedure law, european international procedure law and international arbitration law. At the end of this course the student should be able to understand the system of rules applicable in this area, should be able to explain the jurisdiction of the national courts in cases with foreign element, should be able to analyze the conditions for the recognition and enforcement of the judgment issued by foreign courts. He should be able to explain the differences between the international arbitration procedure, ADR and litigation. He will be able to formulate the arbitration agreement and to explain as the arbitration procedure as the enforcement of the arbitral award.

The aim of the Course of International Private Law is to meet the students familiar with the questions of private relationsships with the foreign element. The first part of this course will be devoted to international private and procedure law. The subject of the second part is international arbitration law. This two parts are common for all students. • The first part of the course will be devoted to the issues of international arbitration. The second part of the course is concerned with exclusive issues of European International Private Law and the lectures will focus on: creating common European judicial framework - the analysis of the Treaty of Rome on the law governing the contracts - the analysis of the Brussels Convention on the powers of courts and the recognition and enforcement of the courts' judgements - interpretation activities of the European Court of Justice in respect of the above-mentioned treaty and convention - the analysis of the Lugano Convention on the powers of courts and recognition and enforcement of courts' judgements. The seminars for the first part will anylyse the issues of arbitrary contracts, arbitrary findings and their enforcement , termination, etc. The seminars for the second part will cover the judgements of the European Court of Justice in relation to individual conventions.

Course objectives

The aim of the Course of International Private Law is to meet the students familiar with the questions of private relationsships with the foreign element. The first part of this course will be devoted to international private and procedure law. The subject of the second part is international arbitration law. This two parts are common for all students. In the third part of the course the students might choose between the European international private law and The questions of international private law before courst.věnují buďto problematice evropského mezinárodního práva soukromého nebo vybraným otázkám v mezinárodní justiční praxi.

Syllabus

• The first part of the course will be devoted to the issues of international arbitration. The second part of the course is concerned with exclusive issues of European International Private Law and the lectures will focus on: creating common European judicial framework - the analysis of the Treaty of Rome on the law governing the contracts - the analysis of the Brussels Convention on the powers of courts and the recognition and enforcement of the courts' judgements - interpretation activities of the European Court of Justice in respect of the above-mentioned treaty and convention - the analysis of the Lugano Convention on the powers of courts and recognition and enforcement of courts' judgements. The seminars for the first part will anylyse the issues of arbitrary contracts, arbitrary findings and their enforcement , termination, etc. The seminars for the second part will cover the judgements of the European Court of Justice in relation to individual conventions.

• Prvá část předmětu bude věnována problematice mezinárodního rozhodčího řízení. Ve druhé části bude již přednášena výlučně problematika Evropského mezinárodního práva soukromého. V rámci ní bude přednášena problematika: - utváření společného evropského justičního prostoru - rozbor Římské úmluvy o právu rozhodném pro smlouvy - rozbor Bruselské úmluvy o pravomoci soudů a uznání a výkonu soudních rozhodnutí - interpretační činnost Evropského soudního dvora k výše uvedených úmluvám - rozbor Luganské úmluvy o pravomoci soudů a uznání a výkonu soudních rozhodnutí V rámci prvé části seminářů bude rozebírána problematika rozhodčí smlouvy, rozhodčího nálezu, jeho výkonu, zrušení, atd. část seminářů se bude věnovat judikátům Evropského soudního dvora k jednotlivým úmluvám.
