Course objectives
Aim of the course is to make students familiar with the work of prof. Urfus. Student will understand the development of conception of state in the Middle ages and in the modern period. He will be capable to use gained knowledge to understand that law is a part of broader economical scope. He will acquire ability to apply information about development of financial relationships, loan and usury.
Syllabus
  • 1. Corpus Iuris Civilis, its conception and circumstances of compilation 2. Medieval schools of Roman law, scholasticism 3. Medieval doctrines and relationship between catholic church and Roman law 4. Political universalism of high Middle Ages - role of state 5. Humanism and a Usus modernus pandectarum 6. New conception of state, natural law and great codifications, Savigny versus Jhering 7. Relationship of economical changes and legal thinking, Adam Smith, historical view of financial realtionships – antithesis loan - usury 8. Friedrich August von Hayek – work, ideas, influence upon work of V.Urfuse, cocneption of financial relationships in the modern period 9. Bases of modern legal state – „who wants to understand future, examines the past, who wants to rule the present will erase the past“ ( parafrasis Orwel ) 10. Combined final exam
