Course objectives
The aim of the course is to introduce the concept, purpose and content of discretionary power as an important institute of administrative law, - to provide orientation in the theoretical and practical application aspects of the issue of administrative discretion, and to distinguish it from the institute of vague concepts, - the legislative and application-legal basis, to clarify the specifics of judicial review of discretionary power - the ability to apply in specific cases the general principles of administrative law, which govern discretionary power.
Learning outcomes
After successful completion of the course Discretionary power of public administration: - knows the theoretical knowledge of discretionary power as an important institute of administrative law, - is able to navigate in the theoretical and practical application aspects of the issue of administrative discretion, - is able to explain the legislative and application-legal basis of discretionary power, - understands the essential aspects of judicial review of discretionary power of administrative authorities, - is able to apply in specific cases the general principles of (European) administrative law, which govern discretionary power.
Syllabus
  • The term discretionary powers and administrative discretion. The term decision making and decision-making process. The process of development of the rule of law principle, or more precisely the principle of legality of public administration. The relation between the allegiance and freedom in public administration decision making. Administrative discretion in the administrative law regulation – application, types, identification. Boundaries of administrative discretion. Content of discretion – the relation to object of the law and competence. The term “public interest”. Discretion in the application process. The aspects of administrative discretion (principles). Review of decisions, which are based on the administrative discretion, including judicial review. Relevant judicature.
