Course objectives
The aim of the course is to make the student aware of the possibility of primary use of methods based on cooperation of the parties, which aim at the so-called WIN-WIN dispute resolution, before he/she decides to resolve the dispute in another way (e.g. in court proceedings), and to learn how to apply these amicable procedures in practice. The content will include an introduction to mediation - its theoretical basis, current trends in its use in practice, related legal aspects and practice of practical mediator skills in simulated negotiations.
Learning outcomes
After completing the course, the student will be familiar with the possibilities and advantages of consensual, amicable dispute resolution and the functioning of mediation; he/she will be able to recognize situations suitable for the use of mediation, orientate himself/herself in the related legislation and use basic mediation techniques in practice. Extension of the graduate's profile: after completing the course, the student can continue further study of mediation and subsequently apply as a mediator or registered mediator.

  • Introduction to the study of dispute resolution. A system of dispute resolution methods
  • Communication in conflict, negotiation
  • Mediation - objectives, principles, styles, process, legal framework and areas of application
  • Profession of mediator, ethical aspects, mediation practice in the Czech Republic, current issues of mediation
  • Mediation in the justice system. Judicial and praetorian conciliation
  • Mediation and amicable settlement of disputes in legal practice
  • Other types of out-of-court dispute resolution and ADR
  • Practical exercises of mediator skills. Effective conduct of mediation. Simulation of mediation negotiations

Teaching methods
Theoretical lectures (in the first part of the semester) and practical seminars - simulated mediation sessions, practical exercises of mediator skills (in the second part of the semester).
Assessment methods
Colloquium. A passing grade will be awarded for passing the colloquium test and for active participation in the exercises. Attendance at lectures and seminars is compulsory. The course cannot be taken in ISP mode.
