Course objectives
The course gives information on concepts and legal institutes of administration of culture. It provides a thorough understanding of legal and economic aspects of protection of national monuments, wheather individual or territorial protection concerns. An attention pays to the rights and duties of the owner of national monument, including those proceed from the Building Act. The course covers also the matter of archeological excavations and surveys, including its non-legal dimension. By passing throught the course, student will be able to understand the system and aim of the public preservation of monuments, solve model situations, be well informed about relevant judicature and will be able to express their own proposals and opinions related to presented cases.
Syllabus
  • 1. Introduction, the culture concept, its structuring, sources of law, incl. european law. 2. The national monument concept, individual forms of protection, UNESCO. 3. Procedure of declaring of national monuments, initiation of administrative procedure, definition of parties, incl. their procedural rights and duties, course of procedure, remedies. 4. Territorial forms of protection, their aim, declaring of monument preserves and zones procedure. 5. Protected zones of national monuments, relation to the construction law. 6. National monuments care, duties of owner of an national monument, penalty for its breach.7. Reconstruction of a national monument, legal standing of affected bodies, legal nature of a binding opinion. 8. Relation of national monuments to the construction law, selected issues. 9. Forms of financial aid to owners of national monument, legal nature of providing financial benefits. 10. Archeological survey, concept, relation to the construction law, legal aspects of funding. 11. Archeological survey, concept, relation to the construction law, legal aspects of funding. 12. Sale and export of objects of cultural value, definition of the concept, terms of export.
