- Main objectives are as follows:
- to understand history and construction of an action that causes double effect;
- to name differences between intended and unintended harm;
- to show significant role of the doctrine of double effect (DDE) in the legal space - Osnova
- 1. Theoretical foundations of the DDE (doctrine of double effect) in ethics.
- Is it permissible to kill someone in self-defence?
- 2. Is the DDE useful theory to justify causing harm?
- Contemporary interpretations of the DDE and terms of moral action.
- Contemporary applications of the DDE and its criticism.
- 3. The DDE and the legislature - dealing with foreseen harm:
- a. Indirect harm and problem of intention of the legislator.
- b. Proportionality as a general principle in law.
- 4. Moral obligation not to harm other people and court’s decisions.
- The analysis of judicial judgments.
- 5. Question about moral dimension of law.
- a. Moral space of law and significant role of deontology.
- b. The DDE and values in the rule of law. Hierarchy or incommensurability of values?
