Cíle předmětu
“Introduction to German Law” is designed for international students who wish to get a first glance into German law. There is no previous knowledge required, nor do students have to speak German at all. We will look at German law from a comparative as well as historical perspective. Especially within the chapter on Constitutional law (Verfassungsrecht) we will often talk about why the new Constitution of 1949 is drafted the way it is and where the shortcomings of previous constitutions have set the ground for a dictator to get the powers he abused so rigorously during the Third Reich and what we can learn from it even (or again) today. Remarks and viewpoints from soon to be Czech lawyers and vivid discussions on the commonalities and difference between Czech and German law are more than welcome. After Constitutional law we will look into German Criminal law (Strafrecht) and German Civil law (Bürgerliches Recht). Participants will be provided with a booklet containing an English translation of the German Constitution (called “Basic Law” – Grundgesetz). There will be a powerpoint presentation for every part of the lecture.
Výstupy z učení
At the end of the course, students should be able to:
- have a good understanding of the German legal system, its history, sources of law etc.;
- locate, analyse and discuss the most important provisions of the German Constitution as to fundamental rights and organisation of state;
- have a good insight into the German Criminal Code (Strafgesetzbuch) and the German Civil Code (Bürgerliches Gesetzbuch).
