Cíle předmětu
It is an introductory course providing students with basic information concerning law of international organizations. The aim of the course is to develop an understanding of the legal basis of the creation and activities of international organizations, to provide students with knowledge of the types, main features and institutional structure of international organizations. The course will familiarize students with the law making by international organizations, its influence on the development of international law, questions of the legal validity of the acts adopted by international organizations.
Výstupy z učení
At the end of the course, students should be able to:
- analyze the nature and content of the legal personality of international organizations;
- make difference between the types of international organizations;
- understand and explain the difference between the powers of international organizations;
- describe the institutional structure of international organizations, the structure of the United Nations;
- understand the decision-making process within international organizations;
- demonstrate an understanding of the content of the case law of the International Court of Justice and other international judicial bodies, the peculiarities of their influence on the development of the law of international organizations;
Osnova
  • Session 1: General provisions on the law of international organizations (history of international organizations; definition of international organization; overview of international organizations that emerged after the Second World War; role of international organizations in modern international relations and its codification).
  • Session 2: Notion and types of international organizations (main features of international organizations; classification of international organizations; membership in international organizations).
  • Session 3: The legal position of international organizations (main indicators of organizations subjectivity; functions and competence of international organizations; attributed powers and implied powers of international organizations).
  • Session 4: Institutional structure. Acts of organs of international organizations (the basis of creation of organs; types and functions of organs; decision-making process in international organizations; Ultra Vires acts; United Nations Organization).
  • Session 5: International legal responsibility of international organizations (history and development of the institute of international responsibility of international organizations; legal analysis of the Draft Articles on the Responsibility of International Organizations).
Literatura
  • Relevant readings and case law of the ICJ will be distributed or made available online prior to the beginning of the course.
