Course objectives
Students will receive basic knowledge about theoretical foundations, principles and goals of applying probation and mediation in criminal justice, including international comparisons.They will become familiar with the application of alternative punishments from the point of view of social work.
Learning outcomes
Student will understand the current state of applying alternative resolutions of criminal cases in practice with the emphasis on specifics of social work in criminal justice Students will be able to understand independently specific cases using the Criminal Code and the Code of Criminal Procedure
Syllabus
  • 1. Comparing retributive and restorative justice concepts - reasons for searching for new forms of societies’ responses to criminality. Explanation of the terms probation and mediation 2. The Probation and Mediation Service – Cooperating institutions Act 257/2000 Coll. about the Probation and Mediations Service, the foundation, historical development, professional activities, cooperating institutions. 3. Activities of the Probation and Mediation Service within criminal proceedings. Mediation as a general method of conflict resolution and mediation as an alternative way of achieving criminal justice. International comparison of mediation models 4. Applying mediation in the activities of the Probation and Mediation Service – principles, rules, methodologies. Other activities of the Probation and Mediation Service during pre-trial proceedings, case studies 5. Juvenile delinquency - Act 218/2003 Coll. – Juvenile Criminal Law, judicial proceedings conducted in children younger than 15 years, methodologies, specifics of working with children younger than 15 years, case studies. 6. Juvenile delinquency - Act 218/2003 Coll. – Juvenile Criminal Law, criminal proceedings against juvenile offender, specifics of working with juvenile offender, probation and other programs for juvenile delinquents, case studies. 7. Community service order as a community sanction - legislation, methodologies, current situation in applying community service order in practice, case studies. 8. Alternative punishment of home detention - legislation, methodologies, case studies. Alternative punishment of a ban on participating in sport, cultural and other social events - legislation, methodologies, case studies. 9. Probation supervision as an example of a long-term cooperation with a client - legislation, methodologies, specific methods of work with clients, case studies. 10. Parole – preparing information/resources for parole release from prison sentence, cooperation between the Probation and Mediation Service and the Prison Service of the Czech Republic, methodologies, case studies.
