Course objectives
Constitutional Law introduces students in basic problems of the theory of the constitution and in values the constitution of the Czech Republic is based on. Further deals with the legal regulation of state power and its organisation in the Czech Republic (separation of powers, particular constitutional bodies, their position to each other, rules of their procedure), then with the relation of state and individuals (citizenship, fundamental rights and freedom, their protection, constitutional foundations of the status of foreigners).

  • Charter of fundamental rights and freedoms. Notion of fundamental right and freedom. Classification. Freedom, liberty, equality, dignity, non-discrimination. State power in the Czech Republic. Constitutional concept. Separation of powers. State power and self-government. Legal status of a state body (organ). Parliamentarism in the Czech Republic. Constitutional status of the Parliament. Bicameral structure. Legislative process. Legal position of Members of the Parliament. Executive power. The head of State. The government and other administrative offices. The Constitutional Court. Legal status. Competence. Types of judicial procedures before the Constitutional Court. Judicial power in the Czech constitution. Legal status, position, activity. The State Attorneys Office. The Supreme Auditing Office. The Czech National Bank. Constitutional foundations of territorial self-government. Other forms of self-government.
