Course objectives
The course International Trade Law consists of three independent modules. The first module focuses on the circumstances and their description under which the business transactions are promoted, especially on the international circumstances. The second module deals with the domestic situation for developing foreign trade and the third, the essential one, examines the issues of legal regulation of international business transactions. The core ot the course "International Trade Law - exercise" is the analyse of CISG - the formulation of terms under CISG, the study of cases under CISG. Main objectives of this course is to understand the legal regulation of the international business transaction. At the end of the course the student should be able to understand and to explain the legal text such as international agreement, to formulate the simple contract terms, to analyse the simple situation with the foreign element and to clasify it, to interprete the CISG.
Syllabus
  • 1.How to write the "klauzurní práci". The formulation of the contract terms. 2. The conclusion of the contract of sale under CISG. 3. The methods of the interpretation of the uniform law. 3. The procedura of the inspectation and the notification of the defect under the art. 38 and 39 of the CISG. 4. The claims of the seller and the buyer under CISG. 5. The damage compensation and vis maior. 6. Case study.
