Course objectives
Main objectives can be summarized as to extend the set of legal theoretical knowledge both regards theoretical issues of legal noesis, methodology, axiology and also to deepen the practical skills of the work in the area of interpretation and application of law. Special interest shall be endowed to explain necessary theoretical and methodological instruments used in legal practice for solving cases. In this respect, a deeper dimension of interpretation and argumentation (legal reasoning) shall be presented. After finishing the course, the students will be able to: - use practical interpretation methods in the context of a concrete legal case; - to use both logical and rhetorical skills from different points of view (barrister, judge, etc.); - finally argue for a plausible and creative legal solution of a case.

  • Examples of legal reasoning - usage of traditional aspects of interpretation
  • Analysis of selected decisions - styles of legal reasoning
  • Creation of a plausible legal solution of a case
  • Easy and hard cases as a practical problem
  • Various attitudes to interpretation (textualism, purposivism, new hermeneutics)

Identification of theoretical problems in practical cases, finding acceptable legal solution with application of knowledge of legal theory and methodology, model cases, examples of legislation and case law, moderated discussion, building up an argumentative position (barrister, judge, review body).
