The course builds on the basic knowledge and skills in the area of public law. Students get the knowledge in the Basic Law course and Administrative Law for Public Economy.

Course objectives
Spending resources from public budgets on the state budget level, on the level of municipalities or other subjects spending public resources, is controlled by specific rules of the European or national legislation also in the sphere of state aid and public contracts. Commission of the European Union, as the competition and internal market institution, has been paying increased attention to state aid nowadays. Similarly, the public contracts are inseparable from the process of transparent resources spending, so as not to favour some of the competitors or break the competition laws and internal market of EU.

The aim of this course is to introduce the theory and practice of state aid and public contracts to the students. We will focus on state aid and its compatible forms, on procedures and decision-making practice of EU Commission and Courts. In the sphere of public contracts, we will pay attention to proper procedures by tender invitation, tender submission, by competition authority supervision, subsidizing, procedures of other inspecting authorities (incl. audits) when penalizing for breaking the rules in tenders, including the current decision-making practice of competition authorities and courts.

At the end of this course the student should be able to:
- Understand the procedures of state aid
- Identify the state aid and implement the appropriate regulation
- Orient oneself in tender invitation in accordance with the law or other provisions (subsidy provider regulations or the in-house regulations of the contracting authority)
- Submit a tender and know the rights of a tenderer
- Identify a malpractice in tender invitation
- Assess the procedure of inspecting authorities when penalizing for breaking the rules and stipulating the financial corrections
- Orient oneself in the decision-making practice of Competition Authorities, European Commission and European Courts in the sphere of public contracts and state aid
- Defend the procedure as a contracting authority, competition authority, tenderer, subsidy provider or inspecting authority
- Search for and interpret the relevant sources supporting the argumentation line

  • Lectures:
  • 1. State Aid - basis of legal regulations, article 107 and following articles of the Treaty on the Functioning of the European Union, modernization of state aid regulations in EU legislation, national methodologies
  • 2. State Aid – Block exemption, state aid for small and medium size enterprises, field of science, research and innovations, employment and education, local support
  • 3. State Aid – Services of general economic interests – social welfare services, transport
  • 4. State Aid – „de minimis“ aid, „de minimis“ register, „single undertaking“
  • 5. State Aid – procedure rules, notification, the role of competition authority, European Commission and national courts
  • 6. Public Contracts – legislation, institutions, basic principles and terms, types of public contracts, estimated value, limits of public contracts, forms of issuing a tender
  • 7. Issuing documentation (requirements, preparation, creation, providing), evaluation criteria, qualification (requirements, qualifications in accordance with the law), profile of the contracting authority, opening of competitive proposals, their evaluation, closing of a tender
  • 8. Public contracts in accordance with the law – open competition, simplified procedure (conditions, usage, initiation, development, deadlines)
  • 9. Public contracts in accordance with the law – published proceedings, unpublished proceedings, general contract, competition dialogue, competition for proposals, special institutions (conditions, usage, initiation, development, deadlines)
  • 10. Public contracts outside the law – (conditions, usage, initiation, development, deadlines, other conditions), exceptions from the law effect
  • 11. Tender invitation specifications co-financed from the European funds, European legislation in the sphere of public contracts.
  • 12. Tenderer’s proposal and the protection against improper procedures in tenders, current decision-making practice of competition authority and courts.

Teaching methods
The course has the form of both lectures and related discussions, self study.
Assessment methods
The course is finished with a written exam. The student is allowed to take the exam after sending an analysis of a public contract chosen by the student at least 5 working days before taking the exam.

"Any copying, recording or leaking tests, use of unauthorized tools, aids and communication devices, or other disruptions of objectivity of exams (credit tests) will be considered non-compliance with the conditions for course completion as well as a severe violation of the study rules. Consequently, the teacher will finish the exam (credit test) by awarding grade "F" in the Information System, and the Dean will initiate disciplinary proceedings that may result in study termination."
