Prerequisites
( MP310Zk Constitutional Law II || CM310Zk Constitutional Law II ) && SOUHLAS
One of prerequisites is SOUHLAS. This will allow the teacher to choose students with a real interest in the subject.

If there will be more students applying for the course, a SOUHLAS will be awarded based on short written submission. Instructions will be sent to students by e-mail.

For the effective participation within the course is neccessary to pass an exam in MP310Zk Constitutional Law II before entering the course.

It is advisable to enter this course within 4th or 5th year of study with greater overview of the Czech Law (especially civil procedure and administrative procedure in particular).

The course is aimed on preparation of legal documents for the Czech Constitutional Court. Therefore all the instructions and materials are in Czech. Also all tasks (i.e. preparation of briefs and claims) will be done in Czech. For this reason the course is not suitable for international students without fluency in Czech.

Course objectives
The course is a legal writing course. It is oriented on specific lawyering skills' training.

After the course student will be able:

  • To explain formal requirements of different files.
  • To prepare a file (constitutional complaint, submission to abstract or concrete bill review) meeting all formal requirements.
  • To structure the text in order to make it clear for the court.
  • To evaluate different strategies of the case and choose the best option for the client.
  • To identify relevant arguments and present them in clear structured way in the text.
  • To analyze the text written by someone else and give a formative feedback to the author of the text.

    This is a skills' training course. Students will work on the improvement of their skills. They will not learn new information about constitutional review or comparative constitutionalism. For these purposes there are courses MVV2868K Srovnávací ústavní soudnictví – institucionální pohled and MV701K Ústavní systémy.

    • 1. Procedural rules. How to work with legal systems, commentaries and other sources of information.
    • 2. Visit to the Constitutional Court.
    • 3. Formal requirements of submissions and how to meet them.
    • 4. Parties of the proceeding. Their motivations and how these motivations affect their submissions.
    • 5. Submission to the Constitutional Court, it's structure and requierements. Practical examples.
    • 6. Proceedings before the Constitutional Court from the attorney's point of view.
    • 7. Proceedings before the Constitutional Court from the lawclerk's point of view.
    • 8. How to give and accept constructive feedback.
    • 9. Practical drafting of a constitutional complaint.
    • 10. Practical drafting of a proposal to abolish a law.
    • 11. a 12. Practical drafting on topics suggested by students.

    Teaching methods
    Introductory explanation and discussion in small teams. Majority of the work within the course consists of domestic preparation of various briefs and analysis of colleagues' work and giving feedback to them.
    Assessment methods
    Active class participation (25 %), preparation of 4 briefs (50 %), giving feedback to coursemates' briefs (25 %).
