Course objectives
• This course will introduce students to the European Insurance Law and enable them to analyze the relevant legal issues;
• This course will provide an introduction to the insurance regulation, insurance contract and providing insurance activity and service in the European Union;
• This course is designed to familiarize the student with the key principles relating to the European Insurance Law, legal provisions concerning the access to the insurance activity, rules of prudential supervision of insureres and formaliteis and formation of the insurance contract. The classes will put theoretical concepts into action through case studies. Students who wish to obtain a basic knowledge of the participants of the single insurance market and relations between each other will also benefit from this course. Moreover it is recommended that those who wish to explore the current regulatory status, the questions raised by the new rules and the evolution of this essential move towards a more integrated European Insurance Market, includes especially coooperation between insurers and other financial institutions;
• Main objectives are as follows:
- good understanding of key aspects of the new European financial regulatory framework for insurers and intermediaries
- good understanding of model of transnational legal harmonisation and implementation of the European Insurance Law;
- detailed knowledge of forms of insurance activity and insurance services in the EU Single Financial Market;
- knowledge of institutional changes of the EU Insurance Regulation and Supervision after the global financial crisis;
- ability to analyze impact of the EU insurance regulation on the domestic law;
- use knowledge to be able to resolve a case studies from the domestic/European insurance law and be able to have a solid understanding of the dynamics of and legal framework pertaining to EU insurance law.

  • 1. Introduction to EU Insurance Law – Treaty Freedoms in the Insurance Sector (Freedom of establishment and Freedom to provide services)

  • 3. Scope of Insurance Regulation in the EU
  • 4. Core Principles of the European Insurance Law
  • 5. The Notion of Insurer, Policyholder, Risk, Insurable interest, Premium, Insurance contract
  • 6. Consumer Protecion in the Insurance Market
  • 7. Insurance Distribution – Intermediaries, Direct Insurance
  • 8. Cooperation in the Single Financial Market – Bancassurance, Financial Conglomerate
  • 9. EU System of Insurance Supervision (European Insurance and Occupational Pensions Authority+ National Supervisors) and Rules for Supervising the Insurers
  • 10. Motor Vehicle Insurance System
Teaching methods
Introductory lectures followed by class discussions, comparative studies and case studies
