Children's Delinquency (Topical Legal and Psychologic Aspects)

Anotace: V souladu se zadáním jsem tuto práci rozdělila na část teoretickou a na část praktickou. V úvodu teoretické části jsem se nejprve věnovala výkladu stěžejních pojmů dětské delikvence. V první kapitole jsem zaměřila také na charakteristické rysy dětské delikvence. Přitom jsem nastínila několik možných otázek, které dětskou delikvenci provází. Soustředila jsem se zejména na problematiku brutality, závislostí a masmédií a jejich možnou souvislost s dětskou delikvencí. Dospěla jsem k názoru, že tato témata jsou velice úzce spjata a propletena. Následující část práce jsem věnovala jednotlivým vývojovým stádiím jedince v souvislosti s dětskou delikvencí. Domnívám se, že existuje určitá propojenost mezi jednotlivými etapami vývoje jedince a dětskou delikvencí. Každé vývojové období má svá specifika, která musí být brána v potaz, aby byla eliminována jakákoli tendence k budoucímu kriminálnímu chování. Úkolem teoretické části bylo také nastínění možných faktorů, které mohou působit jako případné spouštěče delikventního chování. Nejčastěji byla v této souvislosti zmiňována rodina, škola či vrstevnické skupiny. Relevantním faktorem však může být také řada psychických poruch, poruch osobnosti a dědičnost. Dospěla jsem k názoru, že za nejvýznamnější determinant delikventního chování považuji rodinu. Ta jako první dává mladému jedinci vzorec chování, který ho provází celý život. Seznámení se z významnými determinanty dětské delikvence považuji za důležité, neboť pouze pokud je bereme v potaz,máme šanci uspět v boji proti dětské delikvenci. Nedílnou součástí praktické části je samozřejmě také pasáž věnovaná aktuální právní úpravě, tedy zejména zákonu o soudnictví ve věcech mládeže s důrazem na některé zvláštnosti zákona. Součástí této kapitoly byl i neparný exkurz do historie právní úpravy soudnictví ve věcech mládeže, při němž jsem objevila velké množství shodných znaků současného zákona a soudnictví ve věcech mládeže a zákona o trestním soudnictví nad mládeží z roku 1931. Praktická část diplomové práce se opírala o poznatky uvedené v části teoretické. Zaměřila jsem se na hodnocení statistických údajů o kriminalitě na území ČR a také ve vybraném regionu, tedy v Jihomoravském kraji. V hodnocení statistických údajů jsem dospěla k docela uspokojivému zjištění a to tomu, že kriminalita dětí a mladistvých klesá. Po podrobnější zamyšlení si však pohrávám s myšlenkou, zda je na místě s e z takového poklesu radovat. Nasnadě je otázka, zda tento pokles není spíše způsoben rostoucím počtem latentní kriminality. Tuto myšlenku jsem v praktické části také naznačila. Nedílnou součástí praktické části se stal také výzkum, který jsem prováděla na vybraných školách v Brně. Cílem bylo potvrdit provázanost některých determinantů delikventního chování dětí, uvedených v teoretické části. Po provedeném výzkumu jsem však neodhalila velkou souvislost, přesto však byl pro mne průzkum velkým přínosem. Poslední část mé práce je věnována pozastavení nad efektivitou současné právní úpravy zejména v oblasti trestní odpovědnosti. Součástí problematiky je také otázky snížení hranice trestní odpovědnosti. V souvislosti s latentní kriminalitou a některými dalšími poznatky získanými v praktické části jsem se ve stručnosti zabývala také otázkou prevence a jejího možného vlivu na stav kriminality dětí a mladistvých. V závěru celé práce jsem dospěla k názoru, že dětská delikvence je prokázaný nebezpečný fakt, který v současné společnosti existuje. Přestože v posledních letech má delikvence spíše sestupnou tendenci, neměli bychom usnout na vavřínech a pracovat na tom aby tento trend vydržel. Vzhledem k již nastíněnému problému latentní kriminality vidím řešením celého problému ve vhodně řešeném systému prevence a samozřejmě také účinné právní úpravě. …víceméně

Abstract: At present, the problem of juvenile delinquency is an issue that is being discussed more and more frequently. The modern society provides children with much more freedom than in the past, which results in an increasing amount of young offenders. Juvenile delinquency falls within significant socially pathological phenomena, which (in comparison with the criminality of adults) embody several particularities subject to not only the age, but also the type of committed criminal acts or the manner of their performance. Rise of the juvenile delinquency is subject to many circumstances – mental development, social environment and other important factors. The topic of my thesis is “Juvenile delinquency (current legal and psychological issues)” and the task was to analyse this issue in detail. Its goal is to focus on the factors, that could cause the rise and development of the delinquency of children and to focus on legal regulation and topical problems. In its practical part, the thesis aims at the enquiry on awareness of juvenile delinquency and at statistical analysis of criminality of children and juveniles in the Czech Republic. As indicated above, my thesis is divided into the theoretical part and the practical part. The first chapter of the theoretical part addresses the definitions of the basic terms in the field of juvenile delinquency. Firstly, I dealt with the key term of my thesis, i.e. the delinquency. I have defined this term and compared it to the term criminality. In this chapter I subsequently dealt with the terms: child, youth and juveniles, the correct definitions of which are necessary for the purposes of my thesis. In the first chapter I also included the definition of the term juvenile delinquency, namely to its legal and psychological aspects. The last part of the first chapter deals with the typical attributes of the juvenile delinquency in connection with possible influence of media, violence or dependencies. The second chapter of this thesis deals with the particular development stage of the individual respective to the connection with the juvenile delinquency. Firstly, I focused on the period of early childhood especially on the new-born, infantile and toddler’s period. Subsequently I dealt with the stage of the pre-school and school age, pubescence and adolescence. All the development stage was described on the basis of the psychological resources and I added possible coherences with the juvenile delinquency or the risk of its development. I found out, that each of the stages in children’s development has is own specific features, which have to be made provision for to eliminate possible criminality. The third chapter of the theoretical part deals with the main factors influencing the delinquency of the youth. I divided particular factors to biological, mental and social, and further I dealt with their dilemma. Biological and psychological determinants were analysed namely in connection with the heredity, body constitution, personality disorder/disorders? and development defects. Among the social factors I analysed namely the connection with the family, school and the gangs. I came to the conclusion that the most important factor influencing the delinquency of youth is the family. The family is the first social group which influences a child’s behaviour. Unstable (defective) family background has the strongest influence on the criminal career of young people. The knowledge of the main factors which determinate children delinquency is very important especially for prevention of criminality of the youth. The last chapter of the theoretical part deals with the problems of current legal regulation, especially the Youth Justice Act. In the introduction I provided a short historical excursus into this issue, and then I focused on the single law. I emphasized mainly the basic principles, criminal liability and award punishment upon this law. The applied part of my thesis is divided into three chapters. The first one deals with the trends in the area of the children and youth criminality in the Czech Republic. I focused on the period of past five years. I have evaluated the trends of perpetrated criminal acts in the past period, statistics of prosecuted children and also the nature of the relevant criminal acts. I interpreted these statistics in the development of delinquency in charts and diagrams. The second one deals with the comparison of the development in criminality of the youth in the Czech Republic and the district of South Moravia. After that I found out that delinquency of the youth has a downward tendency, however we have to make provision for a degree of latent criminality. This part also contains my survey performed in the primary schools in Lesná suburbs in Brno, in which I focused on the questions that were connected to the main factors influencing the delinquency. The goal of this survey was to prove the factual coherence of juvenile delinquency with the incidence of factors that I analysed in the third chapter of the thesis. This survey was connected with the issue of the prevention of the juvenile delinquency with an emphasis on the prevention in schools. The last part of my thesis deals with the topical issues of the effectiveness of the current legal regulation namely on the issue of the decrease in the criminal liability limit de lege ferenda.. The chapter is opened by a passage evaluating the development in youth’s delinquency after the Youth Justice Act had been passed. The last passage presents the currently hot issue of decreasing the legal responsibility limit. The society is divided into two parts. One part agrees the other part does not. I found out that the lowering of this limit does not result in the problem of the criminality of the youth as a hole. Zadání: Diplomová práce bude zpracována ve dvou základních částech: teoreticko-doktrinální a aplikační. V teoretické části diplomantka spojí základní poznatky vývojové psychologie a jejich výraz v legislativní činnosti a právní praxi. Teoretická část práce obsáhne rovněž právně historický exkurz (vývoj právní úpravy v předmětné oblasti v České republice a její současný obraz). Aplikační část práce bude obsahovat analytický pohled na dětskou delikvenci v regionu ČR, který diplomantka samostatně zvolí. V této části práce bude předmětem zájmu diplomantky především dynamika popisovaného problému v období asi pěti let. V závěru práce vyvodí diplomantka k dané problematice samostatné "de lege ferenda" argumenty a návrhy. Literatura: Čírtková, L.: Dva pohledy na delikvenci dětí a mladistvých.
