Course objectives
The course is focused on asylum and immigration law, dealing not only with Czech legislation, case-law and to some extent also with the European asylum acquis and with the relevant international conventions (Geneva Convention, European Convention on Human Rights). The theory lessons are complemented by practical exercises in which students may try to write an appeal and other legal submissions, they may take part in a moot court, etc. Feedback is provided not merely by the teacher but also by invited external lecturers (Miroslav Jurman from the Supreme Administrative Court, Pavel Pořízek and Miloš Valášek from the Public Defendor of Human Rights Office, Lucie Atkins, expert in legal argumentation). The lessons are also complemented by practice in a local NGO, SOZE, which provides free legal counselling to asylum-seekers and other aliens. Practice includes not merely visits of the NGO, but also travelling to detention and asylum centres run by Ministry Interior. Students may see the legal counsellors of NGOs in practice and are also given opportunity to provide legal counselling themselves. Apart from (non-exhaustive) theoretic basis of asylum and immigration law, the course aims to show students what work of a lawyer in an NGO requires, and how to provide assistance to a specific group of persons who are often dependent on the assistance of NGOs. The students are also - in seminars - given opportunity to try what later in their legal practice will influence the results of disputes.

  • 1. Introductory lesson Asylum law - introduction a) Legislation on refugees (The 1951 Convention relating to the Status of Refugees, law No. 325/1999 Coll., on asylum) b) Basic terms c) Forms of international protection 2. Procedure on international protection – Ist instance a) Procedure on international protection b) Ist instance procedure: subjects, their procedural rights and obligations c) Interview with asylum-seeker d) Decision in 1st instance, its content, its legal effect 3. Psychological aspects in international protection procedure a) specific groups of asylum-seekers – mothers with children, single mothers, single women, unaccompanied minors, handicapped asylum-seekers b) dealing with the trauma of asylum-seekers c) communicating with asylum-seekers from diverse socio-cultural environment d) work with asylum-seekers from the viewpoint of a worker of the asylum centre or integration asylum facility 4. Procedure on international protection in courts a) appeals against decisions of Ministry of Interior: procedural rights and obligations, specific problems in asylum court proceedings (language, legal representatives, interpreters etc.), legal effects of a court decision b) cassation appeal against the judgment of regional courts: procedural rights and obligations, admissibility of cassation appeal in the Czech Republic, legal effects of the decision of Supreme Administrative Court c) visa during the court procedure d) case-law of the Supreme Administrative Court 5. EU and protection of refugees a) European Community – 1st pillar b) Dublin regulation c) qualifications and procedural directives d) transposition of the directives in the Czech law 6.
