Course objectives
After passing this course student is able to:
choose the sufficient option to resolve the disputes in relations with international element
analyse arrangements of resolving disputes and to identify risks associated
construct arbitration agreement, arrangement of choice of court and contractual arrangements relating to resolving disputes through ADR mechanism;
take into account legal and geographical aspects of forms of resolutions of disputes;
apply legal sources regulating international commmercial judiciary and arbitration.
Syllabus
  • Types of resolution of disputes in international trade (advantages, disadvantages).
  • Principles of each type of settlement of disputes.
  • Relationship between different methods of dispute resolutions.
  • Method of dispute settlement with regard to recognition and enforcement of decision in foreign state.
  • Prorogation (choice of court).
  • Arbitration agreement.
  • Course of arbitral proceedings and applicable law in arbitration (difference to court proceedings).
  • Control and auxiliary functions of the courts in arbitration (recognition, dissolution, enforcement).

Teaching methods
combination of lectures and practical preparation for class discussion (or homework)- students should be able to apply the theory and knowledge based on their study during practical exercises(hypothetical cases, drafting of clauses etc.)
Assessment methods
Learning takes place through lectures with space for discussion controlled under powerpoint presentations.
Combined exam: Written part of the exam is in the first part aimed to ability to construct contractual arrangements concerning dispute resolution, in the other part to theoretical analysis of selected issues. Oral part (follows the successful completion of the written part) is aimed to discussion over winning issue.
