Cíle předmětu
At the end of the course, students will be able to do the following:
1) Understand the latest developments and trends in U.S. intellectual property law
2) Interpret the key provisions of U.S. intellectual property statutes that have been affected by the latest developments
3) Identify issues that are affected by the latest changes in U.S. intellectual property law
4) Create strategies for protecting and enforcing intellectual property rights in the United States, given the latest developments in U.S. intellectual property law

  • Overview of the course; institutional structure, court system, and current issues in intellectual property law protection and enforcement
  • Class 2 Protectible subject matter (I): Copyright
  • Latest developments concerning subject matter protectible by copyright, including useful articles, performances, and computer programs
  • Class 3 Protectible Subject Matter (II): Trademarks
  • Latest developments concerning subject matter protectible by trademarks, including disparaging marks, the requirement of use, and the interaction of trademarks and other markings and designations
  • Class 4 Protectible Subject Matter (III): Patents
  • Latest developments concerning subject matter protectible by patents that stem from U.S. Supreme Court decisions on patent-eligibility and definiteness
  • Class 5 America Invents Act
  • Latest developments concerning patentability that stem from the implementation of the America Invents Act, particularly developments concerning novelty and non-obviousness of inventions
  • Class 6 Copyright, Transmission, and Intermediary Liability
  • Latest developments concerning transmissions and re-transmissions of copyright-protected works, including the law of internet intermediary liability
  • Class 7 Exhaustion of Intellectual Property Rights
  • Latest developments concerning exhaustion of copyright and patent rights, including questions of digital exhaustion
  • Class 8 Final Review; Current Legislative and Judicial Developments
  • Overview of bills currently pending in the U.S. Congress and cases currently pending before the U.S. Supreme Court, current trends in the lower courts
