Course objectives
The course aims to introduce students to the so-called critical legal theory, a movement that established itself in the 20th century as a combination of critical philosophical and sociological theories with law. Students will become familiar with the dominant critical approaches, particularly the approaches of J. Derrida, J.-F. Lyotard and M. Foucault.
Learning outcomes
Upon completion of the course, the student will be able to: - identify trends in critical legal theory; - identify and describe the dominant theoretical approaches in critical legal theory; - describe the influence of critical legal theory on contemporary legal thought; - apply the critical methodology to the resolution of complex legal cases.
Syllabus
  • The course does not have a curriculum in the classical sense. Specific topics to be determined before the start of the class according to the research focus of the particular learners. However, essential issues include deconstruction, the end of grand narratives, and the archaeology of knowledge or discipline. These themes present in the classic methodological toolkit of critical legal theory will be confronted with the topic that learners are engaged in.
Teaching methods
Class discussion, reading, homework.
Assessment methods
A discussion of the limits and methods of critical legal theory, in relation to the topic of the dissertation. The student will engage in potential critical reflection on the chosen topic and view the topic through the lens of one of the legal critical approaches. The aim of such an evaluation is to look at the dissertation topic through a critical perspective and to try to find potential subversions.
