1 /2 DISCIPLINARY CODE FOR STUDENTS OF THE FACULTY OF ARTS, MASARYK UNIVERSITY Section 1 Subject of regulation (1) The disciplinary code for students of the Faculty of Arts, Masaryk University (hereinafter referred to as the “code″) is an internal regulation of the Faculty of Arts of Masaryk University (hereinafter referred to as the “faculty″) within the meaning of Section 33(2)(e) of Act No. 111/1998 Coll., on Higher Education Institutions and on Modification and Amendment of Other Acts (Higher Education Act), as amended (hereinafter referred to as “the Act″). (2) In the event that this code, the Student Disciplinary Code of Masaryk University (hereinafter referred to as the “MU disciplinary code”) or the Act do not contain special provisions, Act No. 500/2004 Coll., the code of administrative procedure, as amended (hereinafter referred to as the “administrative code″), shall apply to proceedings concerning a disciplinary offence. (3) This code supplements the MU disciplinary code, which stipulates disciplinary offences of MU students, regulates details of the hearing of disciplinary offences and disciplinary proceedings, including the disciplinary committee and its rules of procedure, as well as the rules for imposing sanctions for disciplinary offences. Section 2 Disciplinary offence (1) A disciplinary offence is a culpable violation of an obligation established by law, MU code, or MU Faculty of Arts code that endangers or impairs the interest, activity, or mission of MU or any of its constituent parts. (2) Disciplinary offences are defined in detail in Article 2 of the MU disciplinary code. Section 3 Disciplinary proceedings Details of the hearing of disciplinary offences and disciplinary proceedings are regulated in Part Two of the MU disciplinary code. Section 4 Faculty disciplinary committee (1) The faculty disciplinary committee (hereinafter referred to as the “disciplinary committee”) is a self-governing academic body. (2) The disciplinary committee has six members and two alternates. The term of office of a member of the disciplinary committee shall be two years. (3) The members and alternates of the disciplinary committee shall be appointed and removed by the disciplinary committee by the dean from among the members of the faculty academic community after prior approval of the faculty academic senate. The dean cannot be a member of the disciplinary committee. (4) Half of the members of the disciplinary committee are students enrolled at the faculty. The disciplinary committee alternates consist of 1 student enrolled at the faculty and 1 academic faculty member. Student members of the 2 /2 disciplinary committee may not be in an employment relationship with MU. (5) Before the expiration of the term of office, membership in the disciplinary committee shall be terminated by appeal in accordance with paragraph 3, by written resignation delivered to the dean, or by termination of membership in the relevant part of the academic community of the faculty within the meaning of paragraphs 3 and 4. Membership also terminated upon the creation of an employment relationship in accordance with subsection 4 of section 4. Section 5 Rules of procedure of the disciplinary committee The rules of procedure of the disciplinary committee are governed by Part Three of the MU disciplinary code. Section 6 Delivery Delivery of documents in disciplinary proceedings is regulated by Article 17 of the MU disciplinary code. Section 7 Transitional provisions (1) Liability for disciplinary offences shall be assessed under the existing code if the conduct giving rise to liability occurred before the date of entry into force of this code; it shall be assessed under this code only if this is more favourable to the student. (2) Proceedings commenced before the entry into force of this code shall be completed in accordance with this code. (3) The disciplinary committee established before the entry into force of this code shall be deemed to be the disciplinary committee established under this code. Section 8 Final provisions (1) The disciplinary code of the Faculty of Arts of Masaryk University of 15 May 2017 is repealed. (2) This code was approved pursuant to Section 27(1)(b) of the Act by the academic senate of the Faculty of Arts of Masaryk University on 19 September 2022. (3) This code was approved pursuant to Section 9(1)(b) of the Act by the academic senate of Masaryk University on 7 November 2022.
