Judicial Control of Arbitral Awards

The topic of this seminar is Judicial Control of Arbitral Awards.


Arbitration does not function in vacuum. Therefore national courts ensure that the important state policies are preserved.  

Control function of the courts then lie in the possibility to set the arbitration award aside in case it does not comply with those important policies. However, most writers as well as courts agree that the reasons for challenge of arbitration award ought not to be extended and national courts should be rather reluctant to set the arbitration awards. Moreover, courts are not entitled to examine the arbitration award au fond.

In this connection, it should be metioned that only final award may be set aside.

The grounds for setting the award aside might be divided into two groups:

  • procedural irregularities
  • errors concerning a point of fact or law.

The examples which fall under the first group are lack of jurisdiction of arbitration tribunal, wrong composition of arbitration tribunal or breach of right to a fair trial.

As to the errors regarding a point of law or fact,  example might be that arbitrator exceed his or her mission or powers ( e.g. so called  awards ultra or extra petita).
