(1a) At the World Summit on Sustainable Development held in New York in 2015, the Union and
its Member States committed themselves by 2020, to effectively regulate harvesting and end
overfishing, illegal, unreported and unregulated fishing and destructive fishing practices and
implement science-based management plans, in order to restore fish stocks in the shortest time
feasible, at least to levels that can produce the maximum sustainable yield as determined by their
biological characteristics.

(2) Regulation (EU) No 1380/2013 of the European Parliament and of the Council41 establishes
the rules of the CFP in line with the international obligations of the Union. The objectives of the
CFP are, inter alia, to ensure that fishing and aquaculture activities are environmentally
sustainable in the long term, to apply the precautionary approach to fisheries management, and to
implement the ecosystem-based approach to fisheries management.
(2) Regulation (EU) No 1380/2013 of the European Parliament and of the Council41 establishes
the rules of the CFP in line with the international obligations of the Union. The objectives of the
CFP are, inter alia, to ensure that fishing and aquaculture activities are environmentally
sustainable in the long term, to restore and maintain populations of harvested species to levels
above those which can produce the maximum sustainable yield, to apply the precautionary approach to
fisheries management, and to implement the ecosystem-based approach to fisheries management.

to be insufficient to achieve MSY by 2020. Member States and stakeholders have expressed support
for the development and implementation of management plans for these two stocks at EU level.

fashion and to ensure flexibility and allow evolution of certain measures, the power to adopt acts

delegated to the Commission in respect of supplementing this Regulation as regards remedial
measures for the conservation of mackerel and horse mackerel, implementation of the landing
obligation and technical measures. It is of particular importance that the Commission carries out
appropriate consultations during its preparatory work, including at expert level, and that those
consultations be conducted in accordance with the principles laid down in the Interinstitutional
Agreement of 13 April 2016 on Better Law-Making. In particular, to ensure equal participation in
the preparation of delegated acts, the European Parliament and the Council receive all documents at
the same time as Member States’ experts, and their experts systematically have access to meetings
of Commission expert groups dealing with the preparation of delegated acts.

Management measures
In order to achieve the targets established in Article 4, the following measures shall apply for a
period of four years:
(a) in 2019 the catch limits for small pelagics shall be set at the level of catch in 2017. From
2020, catch limits for small pelagics shall be adjusted in the light of scientific research data
and in accordance with the recommendations of the General Fisheries Commission for the
Mediterranean;
(b) the fishing effort of fishing vessels targeting small pelagics shall not exceed 180 fishing
days per year and 20 fishing days per month, with a maximum of 144 fishing days per year targeting
sardine and a maximum of 144 fishing days per year targeting anchovy;
(c) spatial and temporal fishing activity limits shall be implemented each year in order to protect
nursery and juvenile areas. Such limits shall cover the entire distribution of small pelagics in
the Adriatic Sea, for periods of no less than 15 continuous days and up to 30 continuous days. The
limits shall apply during the following periods: - for sardine, between 1 October and 31 March, and
for anchovy between 1 April and 30 September;
(d) for all fishing vessels whose overall length exceeds 12 metres, spatial and temporal closures
shall also be implemented of at least: 30% of the territorial waters of Croatia and Slovenia for at
least six months; 50% of the territorial waters of Italy for at least four months;
(e) By way of derogation from letter (d) above, in the area of the Gulf of Trieste from the western
coast of Istria to the Lim Channel, those spatial and temporal closures shall apply to fishing
vessels whose overall length exceeds 15 metres;
(f) the overall fleet capacity of trawlers and purse seiners actively fishing for small pelagic
stocks shall not exceed the registered fleet capacity of the active fleet in 2014 in terms of gross
tonnage (GT) and/or gross registered tonnage (GRT) and engine power (kW).

In order to achieve the targets referred to in Article 4, the following management measures shall
be introduced for all fleet segments having anchovy and sardine as their target species:
(a) the number of fishing days shall not exceed 180 in any one year and 20 in any one month; with
maximum of 144 fishing days per year targeting sardine and with maximum of 144 fishing days per
year targeting anchovy;
(b) for all fishing vessels whose overall length exceeds 12 metres, spatio-temporal closures of
small pelagic fisheries:
(i) 30% of the territorial waters and inner sea which has been identified as a nursery area or area
important for the protection of early age classes of fish Croatia and Slovenia for at least six
months each year;
(ii) 50% of the territorial waters and inner sea which has been identified as a nursery area or
area important for the protection of early age classes of fish of Italy for at least four months
each year;
By way of derogation from point (b), in the area of the Gulf of Trieste off the western coast of
Istria to the Lim Channel, those spatio-temporal closures shall apply to fishing vessels whose
overall length exceeds 15 metres;
(c) temporal closure for small pelagic fisheries of at least 15 consecutive fishing days to be
implemented in the following spawning periods of the target species:
(i) for anchovy between 1 April and 30 September;
(ii) for sardine between 1 October and 31 March;
(d) in 2018 maximum catch limit for small pelagics shall be set at 2017 level. Starting from 2019,
maximum catch limit for small pelagics shall be gradually reduced each year for 3% in comparison to
previous year till 2022;
(e) overall fleet capacity of trawlers and purse seiners actively fishing for small pelagic stocks
shall not exceed values of active fleet registered in 2014 in terms of gross tonnage (GT) and/or
gross registered tonnage (GRT), engine power (kW) and number of vessels.

This amendment responds to the main criticism levelled against the proposal for a Regulation, which
is that it does not contain management measures establishing catch procedures, time periods and

Management measures
In order to achieve the targets established in Article 4, the following measures shall apply for a
period of four years:
a) in 2019 the catch limits for small pelagic species shall be set at the level of catch in 2014,
as communicated in accordance with Article 24 of Regulation (EU) No 1343/2011. As from 2020, catch
limits for small pelagics shall be gradually reduced each year by 3% in comparison to the previous
year, until 2022. However, the reduction shall not apply if in the preceding year the total catch
is more than 2% below the 2014 catch level as defined above;
b) the fishing effort of fishing vessels targeting small pelagics shall not exceed 180 fishing days
per year and 20 fishing days per month, with a maximum of 144 fishing days per year targeting
sardine and a maximum of 144 fishing days per year targeting anchovy;
c) spatial and temporal fishing activity limits shall be implemented each year in order to protect
nursery and juvenile areas. Such limits shall cover the entire distribution of small pelagics in
the Adriatic Sea, for periods of no less than 15 continuous days and up to 30 continuous days.
Those limits shall be implemented during the following periods:
– for sardine between 1 October and 31 March, and
– for anchovy between 1 April and 30 September;
d) for all fishing vessels whose overall length exceeds 12 metres, spatial and temporal closures
shall also be implemented of at least:
30% of the territorial waters of Croatia and Slovenia for at least six months;
50% of the territorial waters of Italy for at least four months;
e) the overall fleet capacity of trawlers and purse seiners actively fishing for small pelagic
stocks shall not exceed the registered fleet capacity of the active fleet in 2014 in terms of gross
tonnage (GT) and/or gross registered tonnage (GRT) and engine power (kW).

Justification
The management measures suggested will enable effective action to be taken to regenerate biomass
levels as from 1 January 2019. In addition, it is proposed that, from 2020, catches should be
reduced by 3% per annum from the 2014 level unless the measures introduced (spatial and temporal
closures, etc.) themselves reduce catches by more than 2% compared to 2014. The amendment indicates
procedures and the periods and areas in which catches may be made.

nursery and juvenile areas. Such limits shall cover the entire distribution of small pelagics in
the Adriatic Sea, for periods of no less than 15 continuous days and up to 30 continuous days.
Those limits shall be implemented during the following periods: – for sardine, between 1 October
and 31 March, and for anchovy between 1 April and 30 September;
(d) for all fishing vessels whose overall length exceeds 12 metres, spatial and temporal closures
shall also be implemented of at least: – 30% of the territorial waters of Croatia and Slovenia for
at least six months; – 50% of the territorial waters of Italy for at least four months.
(e) the overall fleet capacity of trawlers and purse seiners actively fishing for small pelagic
stocks shall not exceed the registered fleet capacity of the active fleet in 2014 in terms of gross
tonnage (GT) and/or gross registered tonnage (GRT), engine power (kW) and number of vessels.

scientific advice in sufficient time for the fixing of fishing opportunities.
