Course objectives
The course is aimed to elaborate knowledge from courses MP504K International Private Law I. and MP604Zk International Private Law II. This course has the following objectives:
to confront the theoretical knowledge with legal practice;
to be able to define a negative business practice;
to improve the ability to formulate selected contractual arrangements (for example, the wording of the guarantee, penalty, choice of law);
to improve skills of argumentation in case of litigation before court or arbitral tribunal;
to be able to analyze selected contractual arrangements (in the field of substantive, procedural and conflict of laws).

  • Problematic circumstances of the relationship between direct rules and conflict rules; the scope of priority of application of international treaties.
  • Practical limits on decision-making in arbitration proceedings.
  • Analysis of provisions of the regime I.
  • Analysis of provisions of the regime I.
  • Liability in law of obligations.
  • Payements, modification of foreign exchange, currency and price risks.
  • Detection of the foreign law and treating with the foreign law
  • Analysis of practice of selected institutes - validity of legal acts, coventional penalty.

Teaching methods
lectures followed by class discussion and practical application of the topic (using interactive tools), homeworks (preparation and solution of hypothetical cases, drafting skills, preparation for the moot court), moot court at the end of semester
Assessment methods
Requirements for the colloquium will consist of interim evaluation of the performance of the tasks assigned at the time of teaching in the semester (formulation of the contractual provision under the award, analysis of the contractual provisions).
Students also will be divided into working groups, in which they will implement moot court on the specified topics.
